<br /> That whereas, in an action of partition pendiiag in the District
<br /> Court of Hall County, Neb�ska, wherein Charles K. Mattingly is
<br /> Plaintiff and $oger K. Mattingly et al are Defendants, �for the
<br /> partition of the premises hereinaf ter described, the undersigned,
<br /> Referee appointed by said Court to make partition of said real
<br /> estate, made report in writing duly signed, setting forth that the
<br /> partition of said lands could not be made without great pre�udice
<br /> to the owners thereof, which report was duly examined by the Court

<br /> and the Court, being satisfied therewith, approved and confirmed
<br /> the same and ordered the same to be entered of record and directed
<br /> me as said F3eferee to sell said premises for cash, fifteen (15)
<br /> per cent payable on the day of sale and the balance upon confirma-
<br /> tion of the sale by the Court, and directed such sale to take
<br /> place at the north front door of the Hall County Court House in
<br /> Grand Island, Hall County, Nebraska, and that notices be pub-
<br /> lished in the Grand Island Daily Independent, a legal newspaper
<br /> printed and in general circulation in said County; that I would
<br /> offer the real estate hereinaf ter described for sale at the north
<br /> front door of the Hall County Court House, Hall County, Nebraska,
<br /> on the 31st day of October, 1960, at the hour of 2 o'clock P.M.
<br /> of said day and at the time and place stated in said notiCes; and
<br /> af ter said notices had been published for more than thirty days,
<br /> I offered the said real property for sale at public auction and
<br /> . sold the same to Alfred Wieck for the sum of Eight Thousand Fif ty
<br /> Dollars (�8,050.00) , he being the highest bidder .therefor, and
<br /> afterwards on the lOth day cf November, 1960, said Court approved
<br /> and conf irmed ;said sale, and by an Order directed me as saiS �
<br /> Beferee to execute to said Alfred Wieck a deed conveying the_ said
<br /> land to him in fee simple.
