<br /> EXECUTORS' DEED Il�i PAR?ITION
<br /> KNOW ALL A9EN BY THESE PRESENTS:
<br /> WHEREAS, in the Fourth Paragraph of the Last Will and
<br /> Testament of Oren A. Beltzer, Deceased, who was the owner of
<br /> the following described real estate at the time of his death,
<br /> which Will has been admitted to probate in the manner and form
<br /> provided by law in the County Court of Hall County, Nebraska,
<br /> and which probate has never been set aside nor appealed from,
<br /> there was devised and bequeathed to Nell M. Beltzer, his wife,
<br /> one-fourth (�) of the estate, to be selected by her; and
<br /> WHEREAS, she has selected the following described real
<br /> estate to be partitioned off unto her in partial settlement
<br /> of her said interest in the estate, which setting off has been
<br /> approved by the undersigned as Executors and as the only parties
<br /> having any possible adve�e interest; and
<br /> WHEREAS, on the ,3i day of November, 1960, upon the
<br /> selection made by the said Nell M. Beltzer and the Agreement
<br /> of the parties hereto filed in said County Court, We, as
<br /> Executors, were ordered to set off unto the said Nell M.
<br /> Beltzer the following described real estate as a partition of
<br /> the assets of the estate, and we were ordered to make, exe-
<br /> cute and deliver a deed evidencing said partition;
<br /> NOW, THEREFORE, We, James Beltzer, Joanne Beltzer Flory,
<br /> and William Beltzer, both as Executors and personally, and
<br /> Bernice Beltzer, Robert Flory, and Sharon Beltzer, our re-
<br /> spective spouses, in consideration of these premises, do hereby
<br /> convey, grant, and confirm unto the said Nell M. Beltzer, the
<br /> following premises situated in Hall County, State of Nebraska,
<br /> to-wit: '
<br /> The West One-half of the Northeast Quarter (W'�zNE�� and
<br /> the East One-half of the Northwest Quarter (E'��]W%) of Sec-
<br /> tion 8, Township 9, Range 12, Hall County, Nebraska;
<br /> The IJortheast Quarter (NE�) arid the East One-half of the
<br /> Northwest Quarter (E'.�Ni9%) of Section 22, Township 12, Range
<br /> 10, Hall County, Nebraska;
<br /> The Southwest Quarter of the Northwest Quarter (SW�.aN�N�)
<br /> and the East Cne-half of the Northwest Quarter (ES�iW%) of
<br /> Section 7, Township 10, Range 12, Hall County, Nebraska;
<br /> All of Lot One (1) in Fractional Section 7, and also the
<br /> West half of the Northwest Quarter (W%�NNi%) of Section 8, except
<br /> for a tract of land containing approximately 2.33 acres, more
<br /> or less, described as follows: Beginning at the southeast
<br /> corner of the SW%4IVW% of Section 8, in Township 11, North, Range
<br /> 9, running thence North, along the East line of said SW%4NW'/
<br /> 240 feet, running thence West, parallel to the south line of
<br /> said SW��NW%, 423 feet, running thence south, parallel to the
<br /> East line of said SW'�1W% 240 feet, running thence East along
<br /> the South line of said SW'/�TW� , 423 feet to the point of be-
<br /> ginning, and a small tract of land in the W�% of Section
<br /> 8, described as follows: Beginning at the Northwest corner
<br /> of said W'�1W�, thence East 200 feet along the north line of
<br /> said section, thence Southwest at an angle of 35° and 00"
