<br /> Know all men by these presents that:
<br /> Whereas, in an action of partition pending in the District
<br /> Court of Hall County, Nebraska, where A�abel G. Shafer and Lloyd C.
<br /> Shafer, her husband, and Inez G. Britt, were plaintiffs, and
<br /> Lena M. Adams, a single person, Orville B. Shafer, a single person,
<br /> Lena M. Adams, tenant in possession, and Lawrence Dunmire,
<br /> Administrator of the Estate of John H. Shafer, deceased, were
<br /> defendants, for the partition of the premises hereinafter describeci,
<br /> the undersigned Referee, appointed by said Court to make partition
<br /> ' of said real estate, made report in writing, duly signed, setting
<br /> : forth that partition of� said lands could not be made without great
<br /> prejudice to the owner'�thereof, which report was duly examined by
<br /> , said Court, and said Court being satisfied therewith confirmed the
<br /> same, and thereupon made an Order and caused the same to be entered,
<br /> directing me as said Referee to sell said premises on the following
<br /> terms, to-wit: 15/ cash and the balance upon confirmation.
<br /> And in pursuance of said Order I caused a notice to be
<br /> published in the Grand Island Daily Independent, a newspaper printed
<br /> and in general circulation in Hall County, Nebraska, that I would �
<br /> offer said lands for sale at the main floor of the Court House in
<br /> said County on the lst day of April, 1960, at 2 :OG P.P�i, of said day,
<br /> and at the time and place stated in said notice, and after said
<br /> notice had been published for more than 30 days I offered said lands,
<br /> to-wit:
<br /> ; - � ' Beginning at a point 379 feet east of the southwest
<br /> ; corner of the Southeast �uarter (SE�) of Section
<br /> ' i Five (5) in Township Nine (9) r?orth, Rage Nine (9) , `
<br /> � West of the 6th P.M. ; said point being also the
<br /> � southeast corner of Lot Three (3) of the "County Suo-
<br /> ► division of part of the South Half (S2) of Section
<br /> Five (5) , Township Nine (9) , Range A1ine (9) , ;'�est"
<br /> � ; running thence ncrth 192 feet along the east line of
<br /> said Lot Three (3 ) , and up to the south line oi the
<br /> Madelin Fry Addition to Doniphan, thence east 75 feet,
<br /> along said south line, thence soutr. 192 feet to the
<br /> section line, ar_d thence west 75 feet, along said
<br /> •' section line to the place of beginning; Village of
<br /> Doniphan, in Hall County, Nebraska,
<br /> for sale at public auction, and sold the same to Lena N:. Adams ior
<br /> the sum of �5,$25•00, sh� being the i est bic�r therefor. �nd
<br /> afterwards, on the 1�I'_chy of , 196G, said
<br /> Court approved and confirmed said le and by an Order directed me
<br /> as said Referee to execute to said Lena M. Adams a deed conveying .
<br /> said lands to her in fee simple.
<br /> Now, Therefore, I, Howard E. Tracy, Referee, in conside:ation
<br /> of the premises and the sum of �5,825.00, so bid and paid by said
<br /> Lena M. Adams, and by virtue of the powers vested in me by law,
<br /> do by these presents grant, sell and convey unto the said Lena Ni.
<br /> Adams and to her heirs and assigns the real estate described as
<br /> follows:
