<br /> - KNOW ALL MEN BY THESE PRESENTS:
<br /> THAT, vdHEREAS, in an action in the District Court of the�Eleventh
<br /> Judic,ial District of the State of Nebraska, within and for the County of
<br /> Hall, wherein the County Board of Supervisors of Hall County, Nebraska, ex
<br /> officio the County Board of Public Welfare, is plaintiff and Ben Stewart, et
<br /> als. ,- are defendants, No. 13824, Docket 47, Page 219, the plaintiff did, on
<br /> the .l8th day of March, 1960, obtain a decree finding there to.be due from the
<br /> defendants for old age assistance, in Cause of Action No. Three, the sum of
<br /> $3,854,25, and due the County of Hall, $54,16, accruing interest and costs of
<br /> the suit, and whereas, it was then and there further ordered in the said action
<br /> that in default of the payment of the sum so found due from the said defendants
<br /> that the Sheriff of said County of Hall should cause the lands and tenements
<br /> hereinafter described to be advertised and sold according to law to pay the
<br /> same, and, whereas, default having been made therein, the said Sheriff of said
<br /> County, under and by virtue of the said decree and the order of sale to him
<br /> duly directed, did, on the 2nd day of June, 1960, at the north front door of
<br /> the Court House in the City of Grand Island, in said County of Hall, having
<br /> first given due and legal notice of the time and place of said sale for not less
<br /> th�n thirty ca.ys prior thereto in The Grand Island Daily Independent, a legal
<br /> newspaper, printed and in general circulation in said County of Hall, sell said
<br /> f premises at public �uction to Erwin Rohde and Jean Rohde, husband and wife, as
<br /> joint tenants and not as tenants in common, for the sum of One thousand and no/100
<br /> ($1,000.00) Dollars, (the total accrued costs of suit and sale being �a80.'9) ,
<br /> which sale was afterwards on the 21st day of June, 1960, examined and confirmed
<br /> by the said Court and the s�id E. H. Stobbe as such Sheriff, ordered to convey
<br /> the said premises in fee simple to t'tie said Erwin Rohde and Jean Rohde, husband
<br /> and wife, �.s joint tenants and not as tenants in common.
<br /> NOW, THEREFORE, I, the said Sheriff of the County of Hall, as aforesaid,
<br /> in consideration of the premises and by virtue of the powers vested in me by
<br /> law and the decree of said Court, do hereby give, grant, and convey to the said
<br /> Erwin Rohde and Jean Rohde, husband and wife, as joint tenants and not as tenants
<br /> in common, the premises so as aforesaid sold, to-wit: Fr2ctional Lot Five (5)
<br /> of Fractional Block Forty-nine (49), Russell Wheeler Addition to the City of
<br /> Grand Island, Hall County, Nebraska, Und its complement, Fractional Lot Five (5) ,
<br /> in Fractional Blocic Six (6), of Gilbert's Addition to the City of Grand Island,
<br /> Hall County, Nebraska, =s surveyed, platted and recorded,
<br /> with the appurtenances.
<br /> IT BEING THE INTENTION OF ALL PARTIES HERETO, THAT IN THE EV�NT OF THE
<br /> D�ATH OF EIT'dER OF SAID GRANTEES, THE ENTIRE F�E SIMPLE TITL� TO THE REAL
<br /> ESTAT� DESCRIBED HEREIN SHALL VEST IN THE SURVIVING GRANTEE,
<br /> TO HAVE A:VD TO HOLD THE SAi�1E unto the said Erwin Rohde and Jean Rohde,
<br /> husband and wife, ns joint tenants and not as tenants in common, and their
<br /> heirs �nd assigns forever.
