<br /> KNOW ALL MEN BY THESE PRESENTS:
<br /> THAT, WHEREAS, in an action in the District Court of the Eleventh Judicial
<br /> District of the State of Nebraska, within and for the County of Hall, wherein
<br /> the County Board of Supervisors of Hall County, Nebraska, ex officio the
<br /> � County Board of Public Welfare, is plaintiff and Ben Stewart, et als. , are
<br /> defendants, No, 13824, Docket 47, Page 219, the plaintiff did, on the 18th day
<br /> of March, 1960, obtain a decree finding there to be due from the defendants
<br /> for old age assistance, in Cause of Action No. Nine, the sum� of $4,766.60, and
<br /> due the County of Hall, $77.36, accruing interest and costs of the suit, and
<br /> whereas, it was then and there further ordered in the said action that in
<br /> default of the payment of the sum so found due from the said defendants that
<br /> the Sheriff of said County of Hall should cause the lands and tenements herein-
<br /> after described to be advertised and sold according to law to pay the same, and
<br /> whereas, default having been made therein, the said Sheriff of said County, under
<br /> and by virtue of the said decree and the order of sale to him duly directed, did,
<br /> on the 2nd day of June, 1960, at the north front door of the Court House in the
<br /> City of Grand Island, in said County of Hall, having first given due and legal
<br /> notice of the time and place of said sale for not less than thirty days prior
<br /> thereto in The Grand Island Daily Independent, a legal newspaper, printed and
<br /> in general circulation in said County of Hall, sell said premises at public
<br /> auction to Lew 0. Calhoun and Effie Calhoun, husband and wife, as joint tenants
<br /> and not as tenants in common, for the sum of Ttao thousand, six hundred, seventy-
<br /> five and no/100 ($2,675.00) Dollars, (the total accrued costs of suit and sale
<br /> being $80.79), which sale was afterwards on the 21st day of June, 1960, examined
<br /> and confirmed by the said Court and the said E, H, Stobbe as such Sheriff,
<br /> ordered to convey the said premises in fee simple to the said Lew 0, Calhoun
<br /> and Effie Calhoun, husbattd and wife, as joint tenants and not as tenants in
<br /> common.
<br /> NOW, THEREFORE, I, the said Sheriff of the County of Hall, as aforesaid,
<br /> in consideration of the premises and by virtue of the powers vested in me by
<br /> law and the decree of said Court, do hereby give, grant, and convey to the said
<br /> Lew 0. Calhoun and Effie Calhoun, husband and wife, as joint tenants and not as
<br /> tenants in common, the premises so as aforesaid sold, to-wit: Lots Fifteen and
<br /> Sixteen <15 & 16) , Block Five <5), Dill and Huston Addition to the City of Grand
<br /> Island, Hall County, Nebraska, as surveyed, platted and recorded,
<br /> with the appurtenances.
<br /> IT BEING THE INTENTION OF ALL PARTIES HERETO, THAT IN THE EVENT OF THE
<br /> DEATH OF EITHER OF SAID GRANTEES, THE ENTIRE FEE SIMPLE TITLE TO THE REAL
<br /> ESTATE DESCRIBED HEREIN SHALL VEST IN THE SURVIVING GRANTEE.
<br /> TO HAVE AND TO HOLD THE SAME unto the said Lew 0, Galhoun and Effie Calhoun,
<br /> husband and wife, as joint tenants and not as tenants in common, and their heirs
<br /> and assigns forever.
<br /> IN TESTIMOIdY WHEREOF, I have as such Sheriff hereunto set my hand this
<br /> 23rd day of June, 1960.
