<br /> THIS DEID, made this 13th day of June, 19b0, by and between Conrad Fuss, Jr.�
<br /> of Craig, i.n the �ounty of Moffat, State of Colorado, �xecutor of the Last Will and
<br /> Testament of Conrad Fuss, Deceased� ].ate of Grand Island, in the Co�anty of Hall,
<br /> State of Nebraska, party of the first part, and Lloyd J. Seyler and Veronica C.
<br /> Seyler� both of Grand Island� in the County of Hall� State of Nebraska� parties of
<br /> the second part:
<br /> WITNESSETH that the said party of the first part, the dnly appointed, qualified
<br /> and acting Exeeutor of said Conrad Fuss� Deceased� under his Last Will and Testament�
<br /> which is of record in the office of the Probate Court of Hall County� Nebraska, by
<br /> virt�ie of the power and aut'�ority granted and conferred upon him iinder said �ill� and
<br /> in consideration of the swn of hght Thousand �i.g�t Hvndred Fi.fty Dollars (�8,850.00}
<br /> to him paid by the parties of the second part, the receipt whereof is hereby confessed
<br /> and acknowledged� does by these presents grant� bargain� sell, remise� release� alien�
<br /> conve�r and confirm iznto the said parties of the second part as Joint ienants and not
<br /> as Tenants in Comnori� with survivorship between th�n, all of the following described
<br /> t,^act� piece and parcel of land situate� lying and being in the Covnty of Hall and
<br /> State of Nebraska� to-wit:
<br /> Lot Seven (7) in Block Ninet.y-Four (91�) � t�e Original Town, naFr City
<br /> of Grand Island, Nebraska, according to the recorded plat thereof,
<br /> together with all and singalar the tenements� hereditaments and appurtenances there-
<br /> unto belonging or in anywise appertaining; and also all the estate, right, title�
<br /> interest� property� possession, claim and demand whatsoever, which the said Testator
<br /> had in his lifetime and at th�time of his decease, and which the said party of the
<br /> first part has by virtue of said Last Will and Testament or otherWi.se, of, in or to
<br /> the above granted premises� and every part and parcel thereof with the appurtenances;
<br /> It being the intentinn of all parties hereto that in the event of the death of
<br /> either of said second parties, the entire fee simple title to said real estate above
<br /> described shall vest in the survivor of them;
<br /> TO �AVE AND TO HOLD the said premises, the tract of land aforesaid, with the
<br /> hereditaments and�appurtenances thereof, unto the said second parties and to their
<br /> assigns, and to the survivor of said second parties, and to their heirs and assigns
<br /> of the survivor of them forever;
<br /> And the said party of the first part, for himself, his heirs� execv.tors and
<br /> administrators� does hereby cavenant� promise and undertake to and with the said
<br /> parties of the second part and their assigns, or to the svrvivor of them and to
<br /> the heirs and assigns of such survivor, that he is lawfully the E�ecutor of the
<br /> Last �'�'ill and Testament of the said Conrad F'uss� and has power to convey as afore-
<br /> said, and has in all respects acted, in making this conveyance, in'p��rsuance of the
<br /> ailthority granted in and by the said Last Will and Testament, and that he has not
<br /> made� done or suffered an,y act� matter or thing whatsoever, since he was Ex.ecutor
<br /> as aforesaid, whereb� the above granted premises� or any part thereof, are� shall
<br /> or may be impeached, charged or encumbered in any marcner whatsoever.
