<br /> The covenants, conditions and restrictions runnin� with the land for the h:
<br /> time hereinafter set out, as made a part by reference and attached to the fore- �'
<br /> going conveyance, are as follows: �`

<br /> (1) Keither the tract herein conveyed, nor any part thereof, shall {,
<br /> be used for any purpose prohibited by SECTION V, "A" Business District Reg- tt
<br /> ulations" of Zoning Ordinance No. 2162 of the City of Grand Island, Nebr-
<br /> aska, as passed and approved December 17, 1947, Provided, the Purchasers,
<br /> and the survivor of them,personally may termporarily make any use of the ' y
<br /> tract being sold and purchased which will not permanently prevent compliance 'r
<br /> with such Section V, "A" Business District Regulations". `�.
<br /> (2) The ground floor area of the main structure of any dwelling
<br /> house, exclusive of open porches and garage, shall not be less than One
<br /> Thousand (1000') square feet.

<br /> (3) No building shall be constructed with unsightly materials, :,�
<br /> boxes or salvage lumber; no building or dwelling house shall be moved �
<br /> onto such tract of land; no trailer, tent, garage, shack or other un- S;
<br /> sightly building, or out building, shall/used upon such tract as a resi- .�
<br /> dence. be ��
<br /> (4) No unsightly building materials, junk or rubbish shall be
<br /> <o
<br /> left exposed on such tract except during actual building operations. �f
<br /> ;;?�
<br /> (5) No foul waste water or refuse or garbage or sewage of any '��
<br /> kind shall be permitted to be disposed of upon the top soil of ::�
<br /> ��
<br /> such tract. Al1 sewage shall be conducted through pipes or wholly en- �.;
<br /> closed drains to an adequate and efficient septic tank or chemical disposal �
<br /> receptacle which shall not be closer than. twenty-five (25') feet to any
<br /> lot line of the tract on which it is installed.

<br /> (6) No worn-out discarded auto�obiles, machinery or parts thereof, ��
<br /> shall be stored on such tract and no part thereof shall be used for dis- _`
<br /> carded automobiles, machinery, junk piles, or other storage of any kind f;
<br /> of junk or waste material, unless used for "fill" and adequately covered �
<br />� by soil. ���

<br /> (7) The £oregoing covenants, restrictions and conditions are to
<br /> run with such lands and shall be binding upon all persons and all parties
<br /> claiming ownership thereof until January 1, 1970.
<br /> (8) If any owaer of any lot, or his, her or their heirs or assigns,
<br /> shaZl violate or attempt to violate any of the covenants, restrictions or
<br /> conditions herein set forth, it shall be lawful for any other person or
<br /> persons owning any real estate in said tract to prosecute any proceedings
<br /> at law or in equity against the person or persons violating or attempting
<br /> to violate any such covenants, restrictions or conditions, and to prevent
<br /> him from so doing or to recover damages for such violation, Provided, that ;
<br /> a breach of any such conditions, restricrions or reservations shall not
<br /> defeat or render invalid the lien of any mortgage made in gqed faith for
<br /> value as to any such lot, and, Provided, further, that such conditions, s:
<br /> restrictions and reservations shall remain at all times in full force and �
<br /> • effect as against any owner of any lot for reason of any breach thereof by ,
<br /> any such owner, whether acquiY'ed tsy purchase, foreclosure, devise, inheri-
<br /> tance, or any other manner, and Provided, further that should any one or
<br /> more of any such conditions, restrictions or reservations be declared in-
<br /> valid, by a court of competent juridiction, the covenants, restrictions or
<br /> conditions shall not be affected, but shall continue in full fQrce and ,
<br /> effect.
