<br /> by and between EINAR BENSON-, �ECiJIOR under the ast ill and
<br /> Testament of Elizabeth E. Miller, Deceased, late of Wood River,
<br /> Hall County, Hebraska, PARTY OF '�iE FIRST PART, and ORVILLE R.
<br /> CONN and RUTH ANN CONN, husband and wife, as 3oint tenants
<br /> not as tenants in common, and to the survivor of them, PARTY
<br /> OF THE SECOND PART;
<br /> W ITNE SSETH:
<br /> ___ WHEREAS, Elizabeth E. Miller, Deceased, who was at the
<br /> ;�"—;--`°- time of her death the owner of the real property hereinafter
<br /> ��•��- '`�� described, died at her home in Wood River, Nebraska, on the
<br /> j ,� 23rd day of June, 1959; that she left a Last Will and Testament
<br /> '�� �� with Codicils thereto, which have heretofore, to-wit: on the
<br /> i ' 15th day of July 1959. been admitted to probate in the County
<br /> ' Court of Hall County, N�braska, which court had 3urisdiction,
<br /> �" ' and which probate has not been set aside or appealed from; and
<br /> �_._______�_; WHEREAS, said party of the first part was duly appointed
<br /> — Executor by the County C�ourt of Hall County, Nebraslca, and qual-
<br /> ; � .�� �� ; ified as such Executor on the 15th day of July, 1959; and

<br /> �I�. � WHEIkEAS, the said Elizabeth E. Miller, Deceased, at the
<br /> � '� .a�` time of her death was in possession of the following described
<br /> real estate, claiming to be the owner thereof, and the said
<br /> First Party, as Executor under said Will, ordering him to
<br /> ;�� ' sell said premises and divide the proceeds, is now in poss-
<br /> ;� ession of said premises, claiming to be the owner thereof as
<br /> � -------=-� Executor; and

<br /> � Testament the First Party was ordered and directed to sell
<br /> the real and personal property at public or private sale as
<br /> � � he might deem best, without any order of Court; and

<br /> �^ �� WHEREAS, said first party did on the lOth day of Sep-
<br /> tember, 1959, offer the following described real estat� for
<br /> sale at public sale and sold the same to the second parties;
<br /> �� ������� �� �; NOW THEREFORE, said Party of the First Part, the duly
<br /> ,�- ' � appointed, qualified, and acting Executor of said estate of
<br /> � ` Elizabeth E. Miller, deceased, under said Last Will and ?esta-
<br /> �.�� ' ment, which is of record in the County Court of Hall County,
<br /> '� Nebraska, and by virtue of the powers and authority granted
<br /> � and conferred upon the first party under said Last Will and
<br /> � Testament, and in consideration of the sum of SIXTEEN THOUSAND

<br /> to him paid by the parties of the second part, receipt whereof
<br /> � is hereby acknowledged, does by these presents grant, bargain,

<br /> in common, and to the survivor of them, and to the heirs and
