<br /> THIS DEED, Made th�s lst day of P�[arch, 1960, by and
<br /> between EINAR BEIJSON, EXECUTOR, under the Last Will and
<br /> Testament of Elizabeth E. Miller, Deceased, late of Wood River,
<br /> Hall County, Nebraska, PARTY OF THE FIRST PART, and L[1CY M.
<br /> BACHKORA and FLOYD F. BACHKORA, as joint tenants and not as
<br /> tenants in common, and to the survivor of them, PARTY OF THE
<br /> SECOND PART;
<br /> WITNESSETI?: V.'HEREAS, Elizabeth E. Miller, Deceased, who
<br /> v��as at the time of her death the owner of the real property
<br /> hereinafter described, died at her home in Wood River, Nebraska ,
<br /> on the ?_3rd day of June, 1959; that she left a Last Will and
<br /> Testament with Codicils thereto, which have heretofore, to-wit:
<br /> on the 15th �ay of July 1959, been admitted to probate in
<br /> the County Court of Hall �ounty, Nebraska, which court had
<br /> jurisdiction, and which probate has not been set aside or
<br /> appealed from; and
<br /> WHEREAS, said party of the first part was duly appointed
<br /> Executor by the County Court of Hall County, Nebraska, and
<br /> qualified as such Executor on the 15th day of July, 1959; and
<br /> WHEREAS , the said Elizabeth E. Miller, deceased, at the time
<br /> of her death was in possession of the following described real
<br /> estate, claiming to be the owner thereof, and the said First
<br /> Party, as Executor under said �Nill, orderina him to sell said.
<br /> premises and divide the proceeds, is now in possession of .
<br /> said premises, claiming to be the owner thereof as Executor; and
<br /> WHEREP.S, in the fifth paragraph of said Last �'�lill and Tes-
<br /> tament the first party was ordered and directed to sell the
<br /> real and personal pro�erty at public or private sal.e as he
<br /> might deem best, without any erder of Court; and
<br /> �FdHEREAS, said first party �id �n the 1C'th day of Septe►�ber,
<br /> 1959, effer the following described r�al estate for sale at
<br /> public sale and sold the same tc the second parties;
<br /> NOW THEREFORE , said party of the first part, the duly
<br /> appointed, qualified, and acting Executor of said estate of
<br /> Elizabeth E. Miller, deceased, under said Last Will and Tes-
<br /> tament, which is of record in the County Court of Hall County,
<br /> Nebr.aska, and by virtue of the powers and authority granted
<br /> and conferred u�on the first party under said Last �ill and
<br /> Testament, and in consideration of the sum �f TWELVE THOUSAND
<br /> THREE HUNDRED & NTENTY & NO/100-----------------------DOLLf�RS,
<br /> (�12,320.00) to him paid by the parties of the second part,
<br /> receipt whereof is hereby acknowledged, does by these presents
<br /> grant, bargain, sell, release, remise, alien, convey and con- .
<br /> firm unto the said parties of the Second Part, as joint tenants
<br /> and not as tenants in common, and to the survivor of them, and
<br /> to the heirs and assigns of the survivor of them, and to the
<br /> heirs and assigns of the survivor forever, all the following
<br /> described real estate, situated in the County of Hall, State
<br /> of N�braska, to-wit:
<br /> North half of the Southwest Quarter (1���W�) of Section
<br /> Twenty-two (22) , Township Eleven (11) North, Range
<br /> Twelve (12) , West of the 6th P. M. , Hall County,
