<br /> time of her death the owner of the real f,ro��erty hereinafter
<br /> described, died at her h�me in Y�c�od River, Nebraska , rn the '�3rd
<br /> day cf June, 1959; that she left a Last v►'ill an�' Testament urith
<br /> Codicils thereto, which have heretofore, to-N�it: cn the 15th
<br /> day of July 1959, been admitted to �r.obate in the County?nQUrt
<br /> of Ha11 Ccunty, Nebraska, �rahich court had jurisdicti:^n,
<br /> which prcbate has not been set aside or appealed from; and
<br /> VvNEREAS, said r2rty of the first Nart ��!as duly ap�ointed
<br /> Executor by the County Court ef Hall County, 1lebraska, and qual-
<br /> ified as such Executor on the 15th aay ef July, 1959; and
<br /> Pr'HEREAS, the said Elizabeth E. Miller, c'eceased, at the
<br /> time of her dPath �vas in ^os�?ssion nf the following de�cribed
<br /> real estate, claiming to be the ownFr thFreof, anc the saici
<br /> First Party, as Execut,^x undFr said V�lill, ordering him tc
<br /> sell said premises ana divide the proce�ds, is now in r.oss�s-
<br /> sion of said ;,remises, c.laimina to be the owner thereof as Ex-

<br /> public sale and sold the same to the second parties;

<br /> appointed, qualified, and acting Executor of said estate of
