<br /> tween EINAR BENSON, EXECUTOR under the Last Will and Testa-
<br /> ment of Elizabeth E, Miller, Deceased, late of Wood River,
<br /> Hall County, Nebraska, PARTY OF THE FIRST PART, and r�ELVIN
<br /> J. KN I�HT and K. DOROTHY KNIGf'T, husband and wife, as joint

<br /> WITNESSETH:
<br /> VJHEREAS , Elizabeth E. PQiller, Deceased, who was at the time
<br /> of her death the owner of the real property hereinafter de-
<br /> scribed, died at her home in �J�od River, Nebraska, on the
<br /> 23rd day of June, 1959: that she left a Last U�ill and Testa-
<br /> ment with Codicils thereto, which have heretofore, to-wit:
<br /> on the 15th day of July, 1959, been admitted to probate in
<br /> the County. Court of Hall County, Neb.r.aska, which court had
<br /> jurisdiction, and ��hich probate has not peen set aside or
<br /> anpealed from; and
<br /> UJHEREl�S, said party of the. first nart was duly a�pcinted
<br /> Executor by the County Coiart of Hal1 County, Nebraska, and
<br /> qualified as such Executor on the 15th day of Ju1y, 1`�59; and
<br /> NrHEREAS, in the {ifth naragrarh of said Last Wi11 and Testa-
<br /> ment the first �arty was ordered and directed to se11 the
<br /> real and personal nrocerty at nublic or nrivate sale as he
<br /> miaht deem best, .vithout any crder of Ccurt; and
<br /> l���HEREAS, said first �arty did on the lOth day of �eptember,
<br /> � 1959, offer the following described real estate for sale
<br /> at public sale and sold the same to the second parties; and
<br /> , 4trHEREA5, the said Elizabeth E, ?J�iller, deceased, at the „
<br /> time of her death was in nossession of the following de- �
<br /> scribed real estate, claiming to be the owner thereof, and I /,
<br /> the said First Party, as Executor under said �Jill, order- �
<br /> ing him to sell said premises and divide the proceeds, is
<br /> now in possession o�' said premises, claiming to be the cwner �

<br /> qranted and conferred upon the first party under said Last

<br /> J. Knight and K, Dorothy Knight, husband and wife, as joint
<br /> tenants and not as tenants in common, and to their heirs and
<br /> assigns forever, and to the heirs and assigns of the sur-
