Know all Men by These Presents: That I , J.E.Sonin of the city af �rand I�la�nd I�'e'�raska in Hall County, Nebraska, for and in consideration of the �um of four thouaand three hundred and thirtp dallarB and eight centa � (�4330.08) in hand paid by A.E.Nagel�tock of Fremont Nebrask� the recei�t of which .ie hereby acknowledged, do hereby bar�ain, sell and convey unto the said A.E.Nagelstock all the following described pr o�erty to-wit : �y entire stock of ladies �vearing apparel and merchandise of every kind and nature what�oever now in my store at 110 west third street, rrand I�lanc'� Nebraska, Also all furnishings of every kind and nature whatsoever. Also all fiatures and furniture now located in �aid ��ore and also a11 supplies in the basement . The intention being 3�ereby to conYey to the said A.E.Nagelstock my entire stock of �rierchandise of every kind and nature whatsoaver in said store and baBement ar�d all so all fixture� therein. � � And i further covenant to warrant and defend the title to said pro- perty again�t the lawful claims of all �ersons whomsoever and I covenant to and with the said � . A.E.Nagelstoek that I will x�rot.ect him as againet the elaims of any person or par�one whomso�ver a�serting any claims to the said merchandise or fixture� or any naxt thereof or any proceeds thereof and covenant to warrant and defend hia title as a�ainst the lawful claims o� all pereona � whomsoever. ' � And it is further stipulated and agreed by and between the �artie$ hereto that whe� �a� the said .T.E.Sonin iS indebted to a large number of creditors in l�rge amounts and the egact arrioun� of which i� unknown to the purchaser and som� of Baid claims axe in dispute as to tha amount due thereon and the said J.E.Sonin has made a aworn statement in aceordance with the bulk sales law of the State of Nebraska as to the amount of said indebtednesa but there are uncerta�- nitiea as to the amount due to creditors . NON� THEREFORE� it is agread ae followa, to-wit : That the sum of three thausand eight hundred and thirty doll�rs and eight cents (�3830.08) of the purchase price, above mentioMed, shall be deposited with the Commercial State Bank of �'rand Island , Nebraeka, for �he nurpo�e of paying the claim� against the said J.E.Sonin when presented and saici Commercial State Bank is r authorized to pay said claims as they ars preser.ted and to be paid when o.k. by the said J.E Sonin or when they are found to be and are proved to be correct and the sum of five hundred dollars (�500 .C70) is ta be paid to the said J.E.Sonin at this time . � It is further unde.rstood and agreed tha� the elaim of �Qrs.�oodhue for one thousand dollare (�1000) upon a note, is not to be paid by the Commercial State Bank out of said proceed�. The said PQrs.
