<br /> �aid report , and it further appearing, after a iull examination that said report is correct in a11
<br /> re�pects and ought to be ap�aroved and al�.owed as and for the final account o� �$id Administratri; ',

<br /> ORDE�ED, ADJi?DGED AA1D DECREED that the report o� Josephine 8mout , Administratrix of the.
<br /> Est�A�-e of Thomaa J. Smout , deceased, be and the same is� hereby a;�proved and allowed as and �or
<br /> - her �ina1 acco�t and she ia discharged of her trust.
<br /> ' It ia found by the Court that due and legal notice was given all persons , by posting ,
<br /> and by publication, of the time allo•�ryed and place appointed for pre�enting claims againQt the '
<br /> estate of Thomas J. Smout , .deceased; ; that t�e time allowed for filing claima ha� �ully eacpired;
<br />� that no claim� or demands o� any nature were filed against said estate; that all claims or demanct�
<br /> pen3ing ag�inst said Thomas J. 5mout , or his est:�te,it any such there be, are tr.erafore �orever
<br /> barrad and excluded.
<br /> The Court finds that the sai,l Thomas J. Smout was at the time o? his death the owner
<br /> o� the io�lowing des•cribe3 real estate , si� uated in the County ot Hall and 5tate of Nebraska,
<br /> t o-wit :- The Weat Half oi the t�est Half o� of Sect ion Six (6) , in Town Nine (9) , �'ange Eleven

<br /> The Court tinds that the s�ai3 Thomas J. Smout departe� this li�e, intestate, on the
<br /> 3rd clay of July, 1908, and that he leit surviving him as his heirs• a� law, and his only heirs
<br />� at law, Josephine Smou� his �;idow, and Clara E. Smout , his daughter; that he l�e�t r.o other• child
<br />� or chil.aren, and no chil.;� o� a deceased child, an3 that under the provisions of the law of descer�t

<br />! o� the State o� Nebraska, the afore-r�entione�, and describe�, real estate did pas�s and descend at

<br /> � his dea�th to the sai3 Josephine Smout and Clara E. Smout , in equal shares, to have and to hold
<br /> to them and their heirs and assigns forever, subject to the homestead right ot Josephine Smout
<br /> therein.
<br /> It is there�ore considered and adjudged by the Court that the west 1/2 of the west
<br /> li2 of Section 6, in Tovm 9, Range 11, of whichreal estate the ,�.aid Thomas J. Smout died �eized,
<br /> � did pass at his death to JosePhine 5mout, his wi3ow, and Clara E. Smout, his 3au�ht�r, one halt
<br /> to each, subje�t to the home atea3 rights of tha sai3 widow therein.
