<br /> Davis. Thereupon evider�ce ��as intx°oduced, and the Court, bej.ng fully adviaed in the premises, finda
<br /> that thP fa.cts state� in the Gaid netition a-re true ; th�.t E�.rle G.Johnson, H.G.D�ueller, F.L.H�zg�art,
<br /> �.G.�et�veiler, C.�.r�Iasten, 1�;.L.�o7.laher, P��lph L. Springer, and C.Ray Gates are trustees of the
<br /> Trinity Il�ethodis� Episcop�.l Chureh of Grand Island, NebrRSka, a religious corporation oroanlzed and
<br /> exi�ting under the l�,ws of the state of Nebraska. Th�.t on or about September 1�, z933, the said
<br /> Church v:��.s merged �r�ith the First rulethodist Episcopal Ci�urch of Grand Island,Nebraska; as hereinafter
<br /> set forth, �?zt that sald Trinity 1�7etnodist Episcopal Church stil_l exists as a corporation for the
<br /> vurpoGe of ctosing up all uncompleted busineas transaction� . �
<br /> The Court further f�ndG tll��t prior to uepter.�ber 1�, 1933, the Trinity �Iethodist Episcopal Ghurch �vas
<br /> owner in fee s�mple of Lots Five (5) and Six (6) , Block Fourteen (14} , in the Original Town of Grand
<br /> Island,HaZl County, P1ebr�,e�La, upon v�hich a church builc�ing had been constructed, and wa.s the n
<br /> occupied solely for religious purposes; that it c!as �.lso ov�rner in fee simple of Lots One (1) and
<br /> TPJO (2) in Block Nineteen (19) of said Origin�.I Tov�n, u�on the north half of' v�hich was a church
<br /> edifice v�h�ch had been sold under contrrzet to The Assemhly of God Church of Grand Island, and upon
<br /> the south haZf of which ��ras a paraon 's building OCCUFiP,� and held by said Trinity �'.ethodist Episcopal
<br /> Church.
<br /> The Court fu.rt}Zer finds t�ia.t on and prior to Seprember 1�, 1933, the First Methodist Episcopal
<br /> C'�iurch of Grand IRl�.nd v�as a religious corparation orgar.ized and existing under and by virtue of
<br /> the la�vs of the state of Nebr�ska, owning certain church and parsonage reaZ estate •in said city;
<br /> that on or about said date tNe Nebraska Annual Conference o� the Methodist Episcopal Church, which
<br /> �ras and is tlle hi�hest governin� bod�r in the l�iethodist Episcopal Church for the state of Nebraeka,

<br /> Nebraska, on Septernber 13 to I��, 1933, unite the said Trinity ��ethod.ist Episcopal Ghurch an_d the
<br /> FirGt T2ethodist Episcopal Church into one Methodist Epi.scopal Church, bearing the r�ame of The
<br /> Methodist Episcopal Church of Grand Isl�.nd,Nebraska, therery vesting the titles of� real and per-
<br /> sonal property held by the forMer Trinity Methodi�t Episcopal Church and the Fir�t� ��'.�hodi�t E��:s-- '
<br /> copal Chur. ch in The 1t�ietYiodist Episcopal Church aforesaic�, and vestin�� said property in the duly
<br /> and legally chosen tr.uatees thereof, vrho thus became by such I.aws, rules, diecipline, and uss�ge,
<br /> the legally cor_stituted successors of the Boarda of Trustees oP said Trinity Nrethodiet Eviscopal
<br /> Church and First TJlethoc�.ist Episcopal Church.
<br /> The Court further f'nds that to further evidence the s�.id merger and transfer, the- Trustees of
<br /> Trinity I�et}ZOdist Episcopal Churcil, applic��.nts herein, did, on December l, 1933, executed and
<br /> deliver a deed conve�ring alI of said lots and parcels above described, to The �IIetnodiat Episcopal
<br /> Church of Grand Isl�.i:d, a cornor�tion, w�iich deed was thereafter recorded in Book 7�- of the deed
<br /> recorc�s �f Ha�1 Coun`zj, Neb-r�.sk�., at pa�e 23�, and the posse�sion and ownership of all s�.id real
<br /> estate has been and iG in the said gr��ntee, except that on or about JuZy 15, 1935, the said rlorth
<br /> Half of said Lots 1 and. 2, Block 1�+, aras duly conveyed to The Assembly of God Church aYoresaid,
<br /> in compliance with the contr��ct for the sale thereof. That the said deed d.ated December 1, Z933,
