<br /> Thie cause comin� on to be heard this llth day of August, 1937, upon petition of Grace V.Flippin
<br /> who was hereinbefore appointed executrix and qualified as such in this estate and whose final re-
<br /> port v��as approved and si7e was discharged �,s such executrix by this Court in this cause on June 6,
<br /> 1932, who in said petition informs the Court th�.t an unreleased real estate mortgage Piled in the
<br /> oz"fice of the Register of Deeda of H�,7.1 County, Nebraska, in Sook �+3 of Real Estate �dortgages at
<br /> page 557,has been paid to the best of her knoeaZedge and bel3.ef, on or about the 15th da�y of Januapy,
<br /> 1923, but t��rough neglect and oversig�t, said mortgage was not released and no� stands unreleased
<br /> of record, and if said mortga�;e was not paid, then, a.s sa�:d mortgage was never extended, renewed or
<br /> refiled �.s by la:^ required and is more tha,n ten years past due on it face and therefare barred by
<br /> the Statute of Limit�.tions, and prays for the re-opening of this estate for the s�Ie purpose oP
<br /> releasing said mortgage, and the Court being P.:�lly advised in the premises, finds that this estat�
<br /> shoul.d be reopened solely Por that purpose and said Grace V.Flippin as executrix, be ordered to make
<br /> execute and deliver a release oP said real estate mortgage;

<br /> ZT IS THEREFORE ORDERED BY THE COURT that the above estate be and is hereby reopened for the sole
<br />' purpose of releasing the above described real estate mortgage, and said Grace V.Flippin, as execu-
<br /> trix under the last will and testament o� C.A.Flippin, deceased, be and. ia hereby ordered and dul�
<br /> authorized to� make, execute and deliner a release of the real estate mortgage executed on or about
<br /> December 31, 1915, by Richard Toll and Ida Toll, hie wife, in the sum of �2500.00, aYfecting the
<br /> Pollo�ving described property: Commencir.� at the Northwest corner of the Southwest Quarter of the
<br /> Southwest Quarter of Section No. Twenty-seven (27) Township Eleven (lI) , North of Range Nine (9)
<br /> �Pest o� the 6th P.�. , running thence East Forty (�+0) rods, thence North Forty (40) rods, thence
