<br /> The Court finds that W.E. Sorensen,Adminietrator of the Eetate of Seward R.Benton,deceased,has filed
<br /> a disclaimer in this action pursuent to an order of the Judge of the County Court of Hall County,
<br /> N�bre�ska,dated March 2 ,1937,and that the defendants,Grace Benton,Charles Benton e,nd �aelyn Benton,
<br /> his Wife ,hsve dieclaimed any interest in the property in favor of the plaintiff.

<br /> The Court fur�her finde that in the year 1930 at Cairo,Hall County,Rebrask�,there was a Stet� Ba,nk
<br /> knowA a$ the Cairo 8tate Bsnk,Whieh became involved in financial diff iculties;that a depoeitors�
<br /> commit�ee was appointed,and by eontract With the �e,nking Department of the State of Nebraska,assum�
<br /> ed the duties and obligations of liquidating aaid Ba,nk;that said depositora� commi��ee appoint�d
<br /> one S.R.HentQa ae Trustee of the assets of said Cairo State Be�xik; that said 9.R.Benton is on� and
<br /> th e sam� per son as 9eward R.Benton.
<br /> The Qourt furth�r finde that amon� the assets of said Cairo �tate Bank were sev�ral note$ of one
<br /> Hatti� F. Thompaon,her husband �nd her sons;that it wae impoeaible to collect said notee and a sett�e-
<br /> mdnt was arrart�ed between said Trustee and the depositore� committec of the Cairo 9tate Bank and
<br /> her ,whereby in safd settlement the sa�id Hattie F.Thompeon conveyed the following described reel

<br /> Nebrsska�to S,R.Benton,Trustee,as he wae described as grantee in said deed,and that the designatiom
<br /> of trustee in said deed meant as t�ustee for the depositors of �airo State Bank and the DepoBitors�
<br /> committee,and that the said B.R.Benton had no interest in,right or title to,clsim or lien upon said
<br /> real estate,of any kind or nature whataoever,except aolely as Trustee for the benefit of depositor�
<br /> of ssid Bank. -
<br /> �The Coart further finds thatthe said seward R.Benton died intestate on Deptember 12,1936 ,in Hall
<br /> , County��ebraska,with said premiees etill standing in his name as B.R.Benton,Truetee withou� having
<br /> eonveyed the same; that he left him eurviving hie �'idow,Grace Benton,a son,Charles Bentoa,whose
<br /> wif e is Evelyn Benton,and g minor child over the age of fourteen,a daughter,Jane Benton;that the
<br /> defendant ,tq.E.gorensen,A�ministrator of the Estate of Seward R.Benton was appointed Adminfetrator
<br /> of said eatate on October 20,1936 ,and qualified as Administrator and is now the dulq a,ppointed,
<br /> quaYified and acting adminiatrator of the estate of 9eward R.Bentoa,deceased. :
<br /> Th� Court further finda that the plaintiff ie now the Trustee for the depositors of Cairo 3tate
<br /> Bank,and ie in possession oF said real estate,and a,s eaid Trustee ie entitled to have the titl� to
<br /> said real estate quietmd in his name aB Trustee.
<br /> The oourt further finds that the defendante,and ea,ch and all of them,have no intereet in,right or
<br /> title to,eetate claim or demand in or to eaid real estate,or any par t thereof, or anq li�n thereon.
