<br /> This E3ontract and Agreerrent, made and entered into thi� 15th day of Augu�t, i93�, by and between
<br /> Richard Kuester of Grand Island, Nebraska, of the first part hereinafter rePerred to as "Lessor" ,
<br /> and C.H.Coates of Hastings, Iu'ebraska, and John A.Ochsner of Grand Island, Nebras�a, parties of the
<br /> . second part, hereinafter referred to as "Lessees" , WITNESSETH:
<br /> Th�.t for and in consideration of the covenants and �,greements as hereinafter set forth the parties
<br /> hereto agree as follows :
<br /> � That the fir�t party hereto h��s this day leased unto the second parties, and the second partiea
<br /> h�.ve this d�.y leased fro� the_ fir�t party the follov,ring deseribed real estate situated in Grand
<br /> Island, Hall County, Nebraska, to-wit:
<br /> The ground floor and the basement of the two-story brick building located on the center one-third
<br /> of Lot 3, in Block 65, o� the Original T�v�n, now City, of Grand Island, Hall County, Nebraska,
<br /> together �71th the open space. in the rear on said above described premi�es, for the term of three
<br /> years from the 15th day of October, 1.935, or from a later day of' Ueginning as hereinafter provided.
<br /> For and in consideration of the abov�, Lesaees agree to pay as rent�l Por said premises the sum of
<br /> �130.�0 on the 15th c7.�.y of October, Z935, and the sum oP �130.00 on the 15th day of each and every
<br /> foZlov��ing month for the term of this lease, until said rental shall be madSiPied as hereinaPter pro--� �.�

<br /> Lessees agree to pa�!, in addition to the rentals above reserved, all gas and electric light chaxgea
<br /> incurred in a.nd abou� the premises Ieased and hold the Lessor and the said premises harmless by
<br /> reason of the use of gas and electricity on said premises. Lessees agree to pay the water bill
<br /> Por the use of �vater on said premises and hold the Le�sor and said premi�es harmle=s by reason
<br /> of the use of �vater thereon.
<br /> It is agreed that the use of gas, electricity or water on said premises shall be at the risk oP
<br /> the Lessees, and Lessor ahall not be liable for any dePects in the electric wiring nor in the
<br /> water, eewer, or gas pipes.
<br /> It is agreed th�.t if any rent Uhal.l be due and unpaid, or if dePault be made in ar.y of the coven�.nts
<br /> herein contained, it shall be lawful for Lessor to re-enter said premises and Lessees agree to
<br /> to vacate the premises without notice.
<br /> Lessees agree that they a�iZl use said preMise� as a grocery store and meat market and Por the
<br /> sale of food products that are usually hand.led in stores of such character, and f or no other
<br /> purpose ; that they especially �rill not use or let the said premises, or any part thereof, or
<br /> permit the same to be used for any unlawful purpose; that they will not sell, assign, underlet or
<br /> , relinquish, said:premises, or any part thereof, ��ithout the v��ritten consent of the Lessor under
<br /> penalty of a forfeiture oP all of their rights under this lease at the election of Lessor, providing
<br /> that the consent of' Lessor shall not be arbitrarily �ithheld ��here the sub-leesee offered is a
<br /> responsible person; that Lessees will use due care and dili�;ence in guarding �aid property to
<br /> prevent d�nage and unnecessary waste thereon; that they v��ill obey all of the city ordinances and
<br /> health rules ��ith respect to cleaning the sidewalk of snow and sleet and remove all rubbish that
<br /> may accumul�.te about the premises ; th�.t they will permit no waste to take place on said premises,
<br /> and tha.t during the term of this Iease they valll keep the said premisea in as good condition as
<br /> they are v���ien possession is delivered to them, ordinary wear and te�.r and depreciation excepted,
<br /> without expense to Le�sor, and will, at their ovrn expense, do such painting, pa.pering and repairing
<br /> .

<br /> tions or changes to said premises without the consent of Lessor. That they will replace any
<br /> glass in the vrindows or doors, including plate glass vrindowQ, tnat may be broken or damaged by them
