<br /> This cause came on to be he�rd this 4th day of March, 1937, upon the petition of Arthur �fiese, the
<br /> answer of Ray M.Higgins, Gu�.rdian ad Litem:,for pora �tiese, a.nd the evidence, and vras submitted to
<br /> the Court.
<br /> On consideration whereof the Court finds, that the petition iq Yiled in good faith; that it is
<br /> proper and neces�ary that the prayer of said petition be granted.
<br /> IT IS THEREFORE CONSI�ERED, ORDERED A�1D ADJUDGED BY THIS COURT that Arthur ;�liese bg,and hereby is
<br /> authorized to sign the name of' Y�iis v�ife, Dora Wiese, to a real estate mortgage for the sum of
<br /> �3, 200.00, and thereby pledge the foll.owing described real estate, to-wit:
<br /> �he S�utheast Quarter of the Northeast Quarter (SE�NE4) and tre Northea�t quar�er �f the Southeas�
<br /> Quarter (NE�SE�) of Sect3on Tv�enty-six ( 26) , Township Ten (10) , Range Eleven (I.I) , West of the
<br /> 6th P.I�. , containing eighty (�0) acres more or leGs, Iocated in Hall County, Nebraska.
<br /> The terms and cond�.tiona of said mortgage are as follows ; the payee and mortgagee shall be the
<br /> Land Bank Commissioner, acting pursuant to the Emergency �arm Mortgage Act o� 1933, as amended by
<br /> the Congress o� the United States; the principal amount of the loan shall be �3, 200.0�; the security
<br /> for sa�d mortgage shall be a first lien and mortga.ge on the above described property; the term of
<br /> said loan sYirzll be for a term oP tr�enty-three (23) years ; the intere�t rate ahall be five per cent;
<br /> ner annum, with the same rate on delinqu�ncies ; that said loan shall be on an amortization plan
<br /> whereby the principal �znd interest are payable in semi-annual installments during the term of the
<br /> loan, with the right to make additional payments on the principal on any intere�t date ; that said
<br /> loan is made conditional that a minimum amount of �1.,200.0� insurance be kept in force on the im-
<br /> provements located upon said above de�cribed land, and that the Ioan is a first mortgage and that
<br /> the praceeds of the loan pay the present lien against the security including accumulated interest
<br /> and taxea due; that the .expense of the loan shalI. be the necessary recordin�, abstrReting, and the
<br /> within court expense. .
<br /> . The Court further finds and orders that the proceeds oP said loan of �3,200.00 be uaed as follows,
<br /> To E.W.Augustine to �ay the first mortgage on said security, now due, the sum of �3,�30..63, with
<br /> _
<br /> inter�st after bqarch 15th, 1937 until paid at the rate of 5� per cent. on �3,000.00; to the �ounty
<br /> Trea�urer of Hall �ounty, Nebr�,ska for 1936 real estate taxes the sum o� $37.90; the balance in
<br /> -
<br /> the sum of �31.47 to be used for court costs in th3s action; and the Court finds that each of theee
<br /> purposes is a valid obligation, And that Arthur Wiese and Dora Wiese are both without fldnds with
<br /> which to pay these obligations.
<br /> The fees of the guardi�,n ad litem €�.re hereby Pixed at the sum of �10.00; and the costs of this
<br /> proceeding t�.xed at �$ , together with the guardian ad litem fees are hereby taxed to the
<br /> petitioner.
