<br /> ber�;, the Court finds that the deYendant is a minor of the age of Yifteen yeare and has been
<br /> properly served peraonally by sum�nona iasued regu2arly out of this eourt; tha'� S.J.Bhada was
<br /> appointed guardian ad litem by thia Court with leave to answer instanter and that sald guardian
<br /> ad litem did �SIe his ane�er herein for sald dePendant.
<br /> This cause coming on Purther to be heard and upon h�aring the testimony oPfered and argument of
<br /> eouneel, the court Pinds generally far the plaintifY and that ahe ia entitled to the relief' prayed
<br /> �or; that Peter Heesch, grandfather of this defendant, died testate in said Hall County on the 12th
<br /> day oP September, 1924, whoae will was duly admitted to probate in the county court of_said county
<br /> a.nd that among other provis3ons in sa�.d will, the plaintiff was given a legacy of Thirty-five
<br /> Hundred Dollars out oP sald estate, and that �'erdinand 3toltenberg, Pather oP t,hie defend.ant, was
<br /> appointed trustee to hold sa3d legacy for the plaintiPf for a perlod oP twelve years t'rom '�he
<br /> date oP the deeease of the aA,id Peter Heeech and that a part of said legacy might be used in the
<br /> purchase of a piece of real estate; that said trustee did purchaee Lo'� Seven in Block Four o�
<br /> Wallich�e Addi'tlon to the c�.ty of Grand Island, Nebra$ka as the same is $urveyed, platted and
<br /> reeorded in the office of the Register of Deeds of said Ha.11 County and took titZe to sald premises
<br /> I in his indicidual name, but that said premises were bq �aim held in trust for t��e use and benifit
<br /> of Adelia Kroeger, thSs plaintiff, deed for which was recorded in Boo�c 66 at page 170 oP the
<br /> deed records oP said HaII County.
<br /> The Court Purther 2'inds that the said Ferdinand Stoltenberg colleeted and accounted Por all rents
<br /> ariaing out oY said premises when �he plaintiPf did not occupy the same, and haa dul�r and properly
<br /> aecounted Por such collections.
<br /> The Court further 2'inds that said Ferdinand Stvltenberg departed this life on the �Oth day of du�.y,
<br /> 1936, testate, who�e will was admitted to prabate in the County Court of said County on the �th
<br /> day of September, 1936, which will, however, contained no provision for the disposi�ion of the
<br /> above described premises exeeptin� that it provided in the re$iduary olause that all real eatate
<br /> of the deceaeed not otherwise dispo�ed of, be devised to �rrtelia 3tflltenberg, hie widow, Por the
<br /> period of her natural life and that the remalnder sha1l go to his ehildren, to-wit: Richard
<br /> StaZtenberg, Esther N3etfeldt, Rudolph Stoltenberg, Barney Stoltenberg, Anna Hargefls, Dora Rath- �
