<br /> WHEREAS, PETE�S TRUST COMPANY, above referred to, was on �tovember 25, 1929 taken under �he co rol
<br /> of the public officers of the State of Nebraeka,to-wit; the Department of Trade and Comrnerce

<br /> �PHEREAS, the LYYAN-RICHEF 3AND AND GRAVEL COMPANY deems it necessary that a temporary Truste
<br /> be appointed to aucceed to ail the rights , privileges and duties of said PFTERS TRUST CO�dPA�1Y
<br /> Trustee, as provided for under the terms of said Indenture of Mortga�e, as set forth ia 9ecti
<br /> 3i�c of Arti��.e Thirteen thereof.

<br /> PARtY that the FIRST TRUST C0�'AIQY OF OMAHA, a corporation organized and existin� under and by
<br /> virtue of the laws of the 3ta.te of Nebraska and having a capital and surplus oP more than Two
<br /> Hundred Fif ty Thousand Dollars (�250,000.00) , be and herebp is named and appointed Temporary
<br /> Trustee, succeedin� ae such Temporary Trustee to all the rights and privileges conferred and
<br /> subjeot to all the duties and obligations impdsed upon e�.id PETERS TRUST COMPANY as Trustee

<br /> and secretary of said Lyman-Ric�ey Sand and Gravel Company eXecuted an instrument appointing
<br /> FIRST TRUST CO�tPAI�Y OF O�dAHA," Omaha, 14ebraska, Temporary Trustee, which said instrument of
<br /> appointment is in wor�s and figures as follows:
