<br /> from the amount of such innoice a sum computed at the rate of xental above specified baeed on
<br /> the quantity of gasoline then and there so delivered �.nd the sun so deducted shall be applied
<br /> and accepte�. by Lessor as payment of rentals accxuing under this lease and shall constitute
<br /> Yull payment of rental accruing as based and computed on such deliveries during the period
<br /> " Lessee shall elect to pay said rentals in installments. .
<br /> If at any time during the term hereof Lessor shall.'b� indebted to Lessee on any► account what-
<br /> soever , LeseEe shall have the right to apply any accrued rental upon eaid unpaid indebtednese
<br /> of Leeeor, and Lessor agrees that the amount so applied ehall conetitute rental payment here-

<br /> Lessor covenante and a,grees to and with Lessee that the rents being paid -in the manner and at
<br /> the time prescribed, and the covenants and conditions and warranties herein being a�ll and sin -
<br /> lar kept ,fulfilled and performed,Lessee shall lawfully and peaceablq have,hold,possess,use an
<br /> occupy the premises and pxoperty hereby leased during the term Ysereby granted, or any extenei
<br /> thereof, without any hindsance, disturbance or molestation f rom Lessor; and Lessor hereby war I
<br /> rants and def�nds to Lessee against the lawful claims of all persons whomsoever the premiscs .

<br /> Duxing the term of this lease the Lessor covenants and agree� to pay all general and special (
<br /> ta.xes , including occupation taxes, ax�.d any taxes or charges for water,light,power ,or heat levied
<br /> and assessed, or charged, against said premises or the property of Lessor eituated thereon, o
<br /> on accoun� of the use �or occupancy of any or all thereof; and Lessor shall at its own eapense
<br /> obtain and have issued to and in the name of the Lesaee, or its nominee, any permit or licens
<br /> neeessary or required to operate and maintain said station.
<br /> Lessor shall, at its ovrn cost, maint.�in in good condition andrepair the imprmvements and per-
<br /> sonal property hereby leased. Should said properties be deatroyed, or be so d amaged by fire
<br /> or other casualty as to beeome untenantable, Lessor �hall have eixty (60) day$ within whioh t
<br /> rebuild or replace said properties. In the event Lessor shall f ail or refuse so to do, Les�e
<br /> may �erminate thi� lease. Rentale hereunder sha11 be abated during euch time as Lessor shall
<br /> fail to so maintain and r epair such improvements a.nd personal property, and/or said premises
<br /> $hall be untenantable.
<br /> Lessee $hall have the right and privilege of erecting, placin�, construetin�,equipp3ng,main-
<br /> ta.ining and operatin� on the demised premises and in connection with eaid etation any and all
<br /> structures, improvements,appliances,containera and conveyors of whatsoever kind, on,under and
<br /> above the �round, it may desire to use or ara.y requir� in operating, transacting,carrying on
<br /> and conducting on eaid. premises its business of storing, distrubuting and.�•marketing products
<br /> of refined pe�roleum. Any installation heretofore or hereafter made by Lesaee of ite equip-
<br /> ment, of its signg advertieing itB business, or of a,ny of its property upon said premises
<br /> shall be canclusiva evidence of Lessee�s entry into possession of said premiaes und�er the ter s

<br /> Lessee shall have the right to make proper connections with anp and all water,gas,and sewer�
<br /> linee a,nd pipes on the demised premises, and may continue the use and eerviae thexeof during
<br /> . ths term of thie lease.
