<br /> jcommeneement of any work upon eaid right of way in co�neetion with the construction,maintenanc ,
<br /> repair, renewal or reconstruction of the Pipe L�.ne.

<br /> Section 4. LICENSEE TO BEAR ENTIR� E%PENSE. -
<br /> iThe Licaensee shall bear the entire cost and e�cpense incurred in Qoaneetion with the conatructi n,
<br /> maintenance, repair and renewal and anq and all modification, revision,relocation,removal or
<br /> reconetruction of the Pipe Line, including any and all expense which ma.y be incurred by the
<br /> Railroad aompanp in connection therewith for supervision or inspection, or otherwise.
<br /> i8ection 5. MODT�`ICATION OR RELOCATION OF PIP� LINE.
<br /> � The Licensee sha11, at its eole expense, make anp and all modifieation� or chan�eg in the Pipe
<br /> I
<br /> Line, or move all or any part thereof to such nea► location ae may be required by the Railroa8
<br /> I
<br /> Companp at anq time in con�eatian with the construction, maintenance,repair,reneWa.l,use,oper-.
<br /> �� ation,change,modification ar relocation of railroad tracks, telegraph,telephone,signal _or .othe
<br /> .
<br /> Ipole and wire linee,pipe ltnes and other faoilities of the Railroad Company upon said right of
<br /> way.
<br /> Al1 the terms, conditione and stipulations herein expressed Rith rePerence to the eonetruetion
<br /> maintenance, repair and renewal of the Pipe Line on said sight of we,q in the location here3ir►
<br /> before deecribed shall applp to the Pipe Line as modified, ohanged or relocated within the co
<br /> templation of this section.
<br /> ; 9eotion 6. PTPE LINE NOT TO INTERFER� WITH OPERATION OF R1IILROAD.
<br /> � The Pipe Line sha11 be constructed and at all times maintained,repaired,renewed a.nd operated
<br /> in such manner as to cause no interference whateoever with the Qonstant, continuous and unin-
<br /> terrupted uee of the tracke,property and premises of the �a.ilroad Oompany, and nothin� ehall
<br /> be done or euffered to be done bq the Licensee at any time tha,t would in any ma,nner impair t
<br /> � eafety thereof. • -
<br /> iSectioa 7. CLAIDdS AN33 LIENS FOR LABOR AND MATERIALS - TAXE9.

<br /> � The Licensee shall fullp pap for all materials 3oined or aPfiaed to and labor performed upon
<br /> � said right of way in conneotion with the construc�ion, maintenance,repair, renewal or recon-
<br /> � etruotion of the Pipe Line, and shall not permit or suffer any mechanic�s or materialm�n�s
<br /> ,
<br /> lien of any kind or nature to be enforced against eaid right of way for axiy work dnne or
<br /> I materials fuxnished thereon at the insta.nce or request or on behalf of the Licensee; and the
<br /> Liceneee shall indemnify and hold harmless the Railroad Oompany from and a,gainst any and all
<br /> liens, claima,demands,costs and eapenses of whateoever nature in any way connected with or
<br /> �

<br /> grow�ng out of such work done, labor performed, or materials furnished. ',
<br /> IThe Lioensee shall promptly paq or diecharge a�ll ta�ces,rates,chargee and a.ssesements levied �
<br /> upon, in respect to, or on account of the Pipe Line, so as to prevent the same becomin� a
<br /> charge or 11en upon said riaht of way, or any other praperty of the Railroad Company, and so
<br /> that the taxes,charges and aesessments levied upon or in respect to eaid ri.�;ht of way and oth r
<br /> ' property of the Ra.ilroad Company ahall not be increased because of the loeation,construation
<br /> or maintenance of the Pipe Line or any improveraent.,applfance or fiature conneeted therewith
<br /> placed upon said ri�ht of way, or on aecount of the Licensee'e interest therein. l�here such
<br /> taa, charge or assesement may not be separately made or assessed to the Licensee b�t shall be
<br /> included in the assessment of the right of w�y or other property of the Railroad Company, the
<br /> the Licensee shall pay to the Railroad Company an equitable proportion of such taxes determin d
<br /> by the valuc of the Licensee'e property upon said right of way as compared with the entire
<br /> valus of said right of way. -
