<br /> UNION PACIFIC RAILRt1AD CO�dPANY hereby leases to Margaret A.Callahan (an abutting Iand owner) of
<br /> Shelton Buffal� County, Nebraska, for a period of t�a•enty years from the date hereof (unless sonner
<br /> terminated in aecordance v�ith the terms hereof), a portion of its 400 foot ri�ht of way in Hall
<br /> County, Nebraskay to be used for agrir,ultural purposes only, deacribed as follows: All tha�t part
<br /> o� the Southwest qwarter of Southw�st quarter of Seetion thirty-two (32), in Township ten (10)
<br /> Nortb, of Range t�felve (12} �7est of the $ixth Principal Meridian, which ia included between lines
<br /> parallel �rith and distant reapectively fifty (50) feet and two hundred (200) feet, on the south-
<br /> erly si�e, an� whieh is 3ncluded between lines parallel with and distant respectively six�y-four
<br /> (64) feet and two hundred (200) feet, on the northerly side, from the center line of the south
<br /> main track of Union Pacific Railroad as conatructed and operated over and across said Section
<br /> thirty-two (32) .
<br /> The lea�ehold estate hereby granted shall rur_ with �he title to the abutting lan�, situate3 in
<br /> Hall County, Nebraska, and describe3 as fallows:
<br /> The $outhwest quarter of the Southwest quarter of gection thirty-two (32), in Township ten �10)
<br /> North, of Range twelve (12) West of the Sixth Principal �der3.3ian.
<br /> Should the title af this leasehold at any time during its lif� become senered from the title to
<br /> ' the abutting land, then this lease shall become ipso faeto null and v�id. Any sale or c�nveyanae
<br /> of such abutting lan3 �hall carry with it said leasehold estate and the purchaser or grantee ahall
<br /> become bound by the terms hereof as fully as the original Lessee. The I,essee i� also to notify
<br /> the Lessor of any transfer of the titla of the abutting property ov�med by him.
<br /> As a consideration for this lease the Lessee ie to pay in advance to the Lessor 4ne Dollar per
<br /> annum; to pay all taxes and assessments leviad upon the leased premises during the continuance of
<br /> this lease, not including taxes or assessments levied against the leased premises as a component
<br /> part of the railroad property of Lessor in the �tate, as a whole; to plow and maintain upon the
<br /> outer boundary af Lessor's 400 foot right of way, or as near thereto a,� practicabla, a fireguard
<br /> at least six fset wide; to keep the leased premises free from combustible ma:terial; to plant no
<br /> trees or shrubbery, and to erect no structures thereon�; to put nothing upon the leased premises
<br /> which mi�ht obstruct or interfere with the view. Lessor reserves the right to take temporary or
<br /> permanent posseasion of a11 o r any portion of the laas�d premises whenever their use may become
<br /> necessary or egpedient, in the �udgment of the Lessor, for railroad purposes, including the lo-
<br /> cation of public or private warehousgs, elevators, or other industries with the design to `�acil-
<br /> itate and promote traff��.
<br /> This lease 3s subject to a11 autstanding superior rights, including those in favor of telegraph
<br /> telephone companies and for public high��ay purposes� If by reason of a line change, or otherwise,
<br /> the title of the I►essor shall cease before the expiration of the term above provided, or if the
<br /> leasing of the above 3ascribad premises is held to be, or should become, inconsistent with the
<br /> law of the land, tliis lease sha11 there-u�n terminate. The Lessee ahall have the right to cancel
<br /> this leasa at any time upon 30 days' wr3tten notice.
<br /> This lease i� to becoma null and void upon the failure of Lessee to keep any of the conditions
<br /> hereof and is not to be assigned �ithout ths written consent of the Lessor. The Lessee will sur-
<br /> render peaceable possession of said premises at the expiration of this lease.
<br /> It is un3ers�ood �hat all covenants and agreements herein recited are made by the parties hereto
<br /> for, and shall be binding upon, themselve� and their heirs, egecutors, administrators, successors,�
