�o��a���� <br />NON-UNIFORM COVENANTS. Borrower and Lender further covenant and agr� as follows: <br />22. Acceleration; Remedies. Lender shall give no�ice to Borrower prior to acceleration following <br />Borrower's breach of any covenant or agr�ment in this Secnrity Instrument (bnt nut prior to <br />acceleration nnder Section 18 nnless Applicable Law provid� otherwise). The notice shall spedfy: (a) <br />the defanit; (b) the action reqnired to cure the defanit; (c) a dat� not less than 30 days from the date <br />the notice is given to Borrower, by wluch the default mnst be cared; and (cn that fa4lnre to car� the <br />defanit on or before the date spec3fled in the notice may resalt in acceleration of the sams aewted by <br />this Secnrity Instrament and sale of the Properiy. The notice shall fnrther �inform Borrower of the <br />right to reinstate after accelerat�on and the right to bring a conrt action to assert the non-esHstence of <br />a default or any other defense of Borrower to acceleration and sale. If the defanit �is not cnred on or <br />before the date spedfi� 3n the notice, Lender at its option may rex�nire immed�late payment in fall of <br />all sams secnred by this Security Instrument withont farther demand and may �tnvoke the power of <br />sale and any other remedies permitted by Applicable Law. Lender shall be endtled to collect all <br />egpenses incnrred in pnrswing the remedies provided in this Seciaton 22, 3nclnding, bnt not limited to, <br />reasonable attoraeys' fe�s and costs of title evidence. <br />If the power of sale is invoked, Trnstee shall record a notice of defanit in each connty in whiclr <br />any part of the Properiy is located and shall mail copies of such no6ice �1n the m�nner prescribed by <br />Applicable Law to Borrower and to the other persons prescrYbed by Applicable Law. After the Hme <br />reqnir� by Applicable Law, Trastee shall gtve pnblic nodce of sale to the persons and in the manner <br />prescribed by Applicable Law. Trastee, withont dem�nd on Borrower, shall sell the Pragerty at <br />pnblic anction to the highest bidder at the Hme and place and nnder the terms de�tgnated 9n the <br />notice of sale in one or more parcels and in any order Trastee determines. Trustee may postpone sale <br />of all or any parcel of the Property by pnbLtc annonncement at the tlme and place of any previonsly <br />schednled sale. Lender or its designce may purcLase the Properiy at any sa1e. <br />Upon receipt of payment of the price bid, Trustee shall deliver to the pnrcLaser Trastee's deed <br />conveying the Property. The recitala in the Trastee's deed shall be prima fade evidence of the trath <br />of the statements made thereinm Trastee shall apply the proceeds of the sale in the following order: (a) <br />to all costs and ezpenses of ezerdsing the power of sale, and the sale, fnclnding the payment of the <br />Trnstee's fces actaally incnrred and reasonable attorneys' fees as permitted by Applicable Law•, (b) to <br />all sums secured by this Secnrit� Inslrament; and (c) anq ezcess to the person or persons legally <br />en13t1� to i� <br />23. Reconveyance. Upon payment of all sums s�urerl by this Security Instrument, Lender shall <br />r�uest Trust� to recon�ey the Properiy and shall surrender this Se�urity Instrument �d all note� <br />evidencing debt securefl by this Security Instrument to Trustee. Trust� shall re�onvey the Properiy <br />without wazranty to the person or persons legally entitled to it S�ch person or gersons shall pay any <br />recordation costs. Lender may charga such person or persons a f� for rec:onveying the Progerty, but only <br />if the fe,e is paid to a third party (such as the Truste.e) for services rendered and the charging of the f� is <br />permitted under Applicable La.w. <br />24. Substitute Trastee. Lender, at its option, may from time to time remove Trustee and appoint a <br />successor trust� to any Truste,e apgointed hereunder by an instrument recorded in the county in wltich tbis <br />Security Instrument is re�orded Without conveyance of the Property, the successor trustee shall succee� to <br />all the tifle, power and duties conferred upon Trustee herein and by Applicable Law. <br />25. Reqneat for Notices.
