�A��U���O <br />NON-iJNIFORM COVENANTS. Bonower and Lender further covenant and agre.e as follows: <br />22. Acceleral3on; Remedies. Lender shall give notice to Borrower prior to acceleration following <br />Borrower's breach of any covenant or agreement in this Secnrity Instrament (bnt not prior to <br />acceleration nnder Section 18 unless Applicable Law provides otherwise). The noHce shall sgedfy: (a) <br />the defanit� (b) the action reqnired to care the defanit; (c) a date, not less than 30 daya from the date <br />the natice is given to Borrower, by w}uch the default mnst be car�; and (d) that failure to cure the <br />defanit on or before the date speci8ed in the notice may resnit in acceleration of the sams secnred by <br />th�tss 5ecnrity Instrament and sale of the Property. The notice shall fw�ther �lnform Borrower of the <br />right to reinstate after acceleration and the right to bring a conrt acf3on to assert the non e�istence of <br />a defanit or any other defense of Borrower to acceleration and sale. If the default is not cured on or <br />before the date spedfled �in the noHce, Lender at ita opdon may reqwire immedi�te payment in foII of <br />all anms secnred by th4s Secnrity Instrnment withont fnrther demand �nd may invoke the power of <br />sale and any other remedies permitted by Applfcable Law. Lender shall be entitled to collect all <br />egpenses incnrred in pnrswing the remedies provided in this Section 22, inclnding, bnt not limited to, <br />reasonable attorneys' fees and wsts of title evidence. <br />If the power of sale �ts invoked, TrnsteE ahall record a notice of default in each county in wlutch <br />any part of the Property is located and shall mail copies of sach notice in the manner prescribed by <br />Applicable Law to Borrower and to the other persons presci3bed by Applicable Law. After the time <br />reqnired by Applicable Law, Trast� shall glve pnblic noNce of sale to the persons and �in the manner <br />prescribed by Applicable Law. Trastee, withont demand on Borrower, shall sell the Property �t <br />pnbl�c anctlon to the highest bidder at the time and place and nnder the terma dedgnated in the <br />notice of sale �ln one or more parcels and in any order Trastee determines. Trastee m�y postpone sale <br />of all or any parcel of the Property by pnblic annonncement at the time and place of any previoasly <br />schednled sale. Lender or i� design� may purchase the Property at any sale. <br />Upon receipt of payment of the prlce bid, Trastee shall deliver to the purchaser lrastee's deed <br />convey�ing the Property. The recitala in the Trnsta's de.ed shall be prima f�de evidence of the trath <br />of the statements made therein. Traste,e shall apply the prncceds of the sale in the following order. (a) <br />to all costs and ezpenses of egerdsing the power of sale, and the sale, �inclnding the payment of the <br />Trastee°s fe� actaally �incnrred and reasonable attorneys' fees as permitted by Applicable Law; (b) to <br />a11 snms seenred by this Secnrity Instrument; aad (c) any egcess to the person or persons legally <br />entttled to it <br />23. Reconveyance. Upon payment of all sums s�ured by this Security Instrument, Lender shall <br />request Truste� to r�onvey the Progeriy and shall surrender this Security instr�mmt and all notes <br />evidencing debt securefl by this Se�urity Inslrument to Trustee. Trust� shall reconvey the Property <br />without warranty to the person or persons legally entitled to it Such person or persons sball pay any <br />recordation costs. Lender may charge such person or persons a fee for re�onveying the Properly, but only <br />if the fee is paid to a third party (such as the Trustee) for services rendered and the charging of the fee is <br />permitted under Applicable Law. <br />24. SnbsHtate Trastee. Lender, at its option, may from time to tnne remove Trust� and appoint a <br />successor trustee to any Trustee appointed hereunder by an inst�ument re�ordefl in the county in which tt�is <br />Security Instrument is rec;orded. Without conveyance of the Property, the successor trust� shall succeed to <br />all the title, p�wer and duties conferred upon Trustee herein and by Applicable Law. <br />25. Request for Notices.
