Grantor represents,warrants and covenarns to Lender that: <br /> (a) Grantor has fee simple marketable title to the Property and shall maintain the Property free of all liens,security interests,encumbrances and claims <br /> except for this Deed of Trust and those described in Schedule B,which is ariached to this Deed of Trust and incorporated herein by reference,wi;ich <br /> Grantor agrees to pay and perform in a timely manner, _ <br /> (b) Grantor is in compliance in all respects with all applicable federal,state and loca!laws and regulations,including,without limitation,those relatin�to <br /> "Hazardous Materials,"as defined herein, and other enVironmental matters(the"Environmental Laws"),and neither the federal govemment nor any <br /> other govemmental or quasi govemmental entity has fited a lien on the Property,nor are there any govemmental,judicial or adminisirative actions�vith <br /> respect to environmental mariers pending,or to the best di the Grantor's tcnowledge,ihreatened,which involve the Property. Neither Grantor nor,to the <br /> best of Grantor's 4viowledge, any other party has used,�generated, released,discharged, stored,or disposed of any Hazardous Materials as defi ied <br /> herein,in connectlon with the Property or transported any Hazardous Materials to or from the Property. Grantor shall not conxnit or permit such acti�ns <br /> to be taken in the future. The term "Hazardous Matetials" shall:mean any substance, mate�lal, or waste which'is or becomes regulated by �ny <br /> govemmental authority including,but not limited to,(i)petroleum;(ii}friable ornonfriable asbestos;(iii)polychlorinated biphenyls;(iva those substances, <br /> materials or wastes designated as a"hazardous substar�ce"pursuant to Section 311 of the Clean Water Act or listed pursuant to Section 307 of the <br /> Ciean Water Act or any amendments or replacements to these statutes; (y).those substances, materials or wastes defined as a"hazardous wa>te" <br /> pursuarit to Section 1004 of the Resource Conservation and Recovery Act or any amendments or replacemeMs to that sfatute; and (vi) those <br /> substances, materials or wastes defined as a "hazardous substance" pursuant to Section 101 of the Comprehensive Environmerdal Respor�se, <br /> Compensation and Liability Act, or any amendmerrts or�epiacements to that statute or any other similar state or federaF siatute, rule, regulation or <br /> ordinance now or hereafter in effect. Grantor shall not(ease or perrrpt the subiease of the Property to a tenant or subtenant whose operations inay <br /> resuh in coMamination of the Property with Hazardous Materials or toxic substances; <br /> ., , <br />
