<br /> KNOW ALL MEN BY THESE PRESENTS THAT:
<br /> WHEREAS, in an action of partition pending in the District Court of
<br /> Hall County, Nebraska, wherein Velma A. Humphrey, et al, were plaintiffs,
<br /> and Louise L. Turner, et al, were defendants, for the partition of the
<br /> premises hereinafter described, the undersigned referee, Robert E. Paulick,
<br /> appointed by said Court to make partition of said real estate, made report
<br /> in writin dul si ned, settin forth that artition of said real estate could

<br /> firmed the same, and thereupon made an order and caused the sarr.e to be
<br /> entered, directing me as said referee to sell said premises, at public auction,
<br /> at the North front door of the Court House in Grand Island, Hall County,
<br /> Nebraska, for cash.
<br /> And in pursuance of said order, I caused a notice to be published in the
<br /> Grand Island Daily Independent, a newspaper printed and in general circula-
<br /> tion in Hall County, Nebraska, that I would offer said real estate for sale
<br /> at the North front door of the Court House in Grand Island, I-iall County,
<br /> Nebraska, on the 31st day of August, A. D. , 1959, at 2 o'clock p. m. of said
<br /> day, and at the time and place stated in said notice, and after said notice
<br /> had been published for more than thirty days, I offered said real estate,
<br /> to-wit:
<br /> Lot 7, in Block 142, Union Pacific Railway Company's Second Addi-
<br /> tion to the City of Grand Island, Hall County, Nebraska, for sale at public
<br /> auction, and sold the same to Paul A. McCormick and Mildred L. McCormick,
<br /> husband and wife, as joint tenants and not as tenants in common, for the
<br /> sum of $3, 450. 00, they being the highest bidder therefor. And afterwards,
<br /> on the 4th day of September, A. D. , 1959, said Court approved and con-
<br />' firmed said sale, and by an order directed me as said referee to execute
<br /> to said Paul A. McCormick and �ildred L. McCormick, husband and wife,
<br /> as joint tenants and not as tenants in common, a deed conveying said real
<br /> estate to them in fee simple.
<br /> NOW, THEREFORE, I, Robert E. Paulick, Referee, in consideration
<br /> of the premises and the sum of $3, 450. 00, so bid and paid by the said Paul A.
<br /> McCormick and Mildred L. McCormick, husband and wife, as joint tena;�ts
<br /> and not as tenants in common, and by virtue of the powers vested in me by
<br /> law, do by these presents grant, sell and convey unto the said Paul A.
<br /> McCormick and Mildred L. McCormick, husband and wife, as joint tenants

<br /> Company's Second Addition to the City of Grand Island, Hall County, Nebraska,

<br /> encumbrances and taxes, to have and to hold the same unto them as joint
<br /> tenants and not as tenants in corr,mon, and to their assigns, or to the heirs
<br /> and assigns of the survivor of them `orever.
<br /> IT BEING THE INTENTION OF ALL PARTIES HERETO, THAT IN
<br /> THE EVENT OF THE DEATH OF EITHER OF SAID GRANTEES, THE ENTIRE
<br /> FEE SIMPLE TITLE TO THE REAL ESTATE DESCRIBED HEREIN SHALL
<br /> VEST IN THE SURVIVING GRANTEE.
