<br />~ <br /> <br />20000439 <br /> <br />2c CONSIDER AND ADOPT RESOLUTION ACCEPTING RIGHT-OF-WAY VACATING <br />FORMER RIGHT-OF-WAY AND ASSIGNING RIGHTS AND INTEREST FOR THE <br />WOOD RIVER ROAD RELOCATION PROJECT: Hall County entered into an agreement <br />with Bosselmans for the Wood River Road relocation project. Bosselmans will build the <br />new road and pave it. Once this is completed the County will vacate the old road and <br />convey the ownership of land back to the original owners. Jeffries made a motion and <br />Logan seconded to approve Resolution #00-0090. Arnold, Hartman, Humiston, Jeffries, <br />Lancaster, Landis and Logan all voted yes and none voted no. Motion carried. <br /> <br />RESOLUTION #00- 0 () C{() <br /> <br />A RESOLUTION ACCEPTING DEED OF RIGHT-OF-WAY, VACATING FORMER RIGHT- <br />OF-WAY, AND ASSIGNING RIGHTS AND INTEREST PURSUANT TO AGREEMENT <br />BETWEEN THE COUNTY OF HALL AND BOSSELMAN, INC. <br /> <br />WHEREAS, On June 22, 1999, the County of Hall and Bosselman, Inc. entered into an <br />agreement for relocation of a segment of Wood River Road; and <br /> <br />WHEREAS, construction of said relocated segment has been completed and has been approved <br />by the Hall County Public Works Director. <br /> <br />NOW, THEREFORE, PURSUANT TO THE ABOVE-REFERENCED AGREEMENT, BE IT <br />RESOLVED that the segment of county road right-of-way .located upon parcels 3, 4, and 5, as set <br />forth in Attachments 1, 2 and 3, be hereby vacated and shall revert to the owners of the <br />underlying property, PROVIDED, HOWEVER, that a public easement is hereby reserved upon <br />said property for the construction, maintenance and operation or reconstruction of public utilities <br />in, through, over or under the same. <br /> <br />BE IT FURTHER RESOLVED, the County Board Chairman is hereby authorized and <br />directed to execute, in the name and on behalf of the County of Hall, such documents as <br />necessary to assign any and all rights the County may have in and to parcel 6, as set forth in <br />attachment 4, without warranty of title or authority, to Bosselman, Inc., PROVIDED, <br />HOWEVER, a public easement shall be reserved upon said parcel 6 for the construction, <br />maintenance and operation or reconstruction of utilities in, through, over or under the same. <br />
