<br />P2.0000343 <br /> <br />RESOLUTION #OO-()Q(p3 <br /> <br />A RESOLUTION MODIFYING THE CONDITIONAL USE PERMIT FOR THE EAST <br />HALF OF THE SOUTHEAST QUARTER (E 1/2 SE 1/4) AND THAT PART <br />OF LOT TWO (2) ON ISLAND SOUTH OF THE HALF SECTION LINE, <br />SECTION TEN (10), TOWNSHIP TEN (10) NORTH, RANGE TEN (10) <br />WEST OF THE 6th P.M., HALL COUNTY, NEBRASKA. <br /> <br />WHEREAS, Emil Schaaf, hereinafter referred to as "applicant," is the owner of the <br />following described real estate, to wit: <br /> <br />The East Half of the South east Quarter (EV2 SEl/4) and that part of Lot Two (2) on Island <br />south of the half section line, Section Ten (10), Township Ten (10) North, Range Ten (10) West <br />of the 6th P.M., Hall County, Nebraska; and <br /> <br />WHEREAS, the above-described real estate is located within the AG-l Zoning District; <br /> <br />and <br /> <br />WHEREAS, on March 14,2000, Applicant was granted a Conditional Use Permit by the <br />Hall County Board ~fSupervisors permitting the mining of sand and gravel upon applicant's <br />property; and <br /> <br />WHEREAS, on"(!{J~ /0 , 2000, Applicant submitted a request for modification of <br />Applicant's Conditional Use ermIt, seekmg the elImmatIOn of condItlon (1) restrIctmg the <br />surface area of pond or lakes created by mining activities on Applicant's property; and <br /> <br />WHEREAS, on G~~ II , 2000, the Han County Board of Supervisors held a <br />public hearing upon said applI atlon to modIfy the ApplIcant's CondItlonal Use Permit. <br /> <br />NOW, THEREFORE, the Hall County Board of Supervisors hereby modifies the <br />Conditional Use Permit granted to Applicant on March 14,2000, by elimination of restriction <br />that "any ponds or lakes created by the mining of sand and gravel upon the said real estate shall <br />not exceed a combined total of twenty (20) surface acres condition." Said Conditional Use <br />Permit and the use of said lands shall be SUBJECT TO THE FOLLOWING CONDITIONS, <br />RESTRICTIONS AND LIMITATIONS: <br /> <br />(A) All dead trees, rubbish and debris, if any, must be cleared from the above described <br />real estate as soon as practical and said real estate must, at all times, be kept in a clean and neat <br />condition. <br /> <br />(B) No trash, rubbish, debris, broken concrete, dead trees, lumber, bricks, refuse or junk <br />material of any nature whatsoever shall be dumped, placed or located upon said real estate. <br /> <br />(C) Applicant shall not use said real estate in such a way so as to create or result in an <br />unreasonable hazard or nuisance to adjacent landowners or to the general public. <br />
