<br />(20000314 <br /> <br />RESOLUTION #OO-OOCo , <br /> <br />A RESOLUTION APPROVING A SUBDIVISION OF A TRACT OF PROPERTY <br />LOCATED IN THE NORTHWEST QUARTER (NW ~) OF SECTION ELEVEN (11), <br />TOWNSHIP TEN (10) NORTH, RANGE TEN (10) WEST OF THE 6th P.M., HALL <br />COUNTY, NEBRASKA <br /> <br />WHEREAS, Darwin Katzenberg, hereinafter referred to as "Subdivider," is the owner of <br />a tract ofland located in the Northwest Quarter (NW ~) of Section Eleven (11), Township Ten <br />(10) North, Range Ten (10) West of the 6th p.m., Hall County, Nebraska; and <br /> <br />WHEREAS, the aforesaid tract is located within the zoning jurisdiction of the City of <br />Grand Island; and <br /> <br />WHEREAS, Subdivider desires to petition the Regional Planning Commission and the <br />City of Grand Island to approve a subdivision his property; and - <br /> <br />WHEREAS, the City of Grand Island's subdivision regulation require that lots within a <br />subdivision have street frontage on a road or street dedicated to public use; and <br /> <br />WHEREAS, the aforesaid tract has frontage on a surveyed road which, although not <br />dedicated to public use, has been used by the Subdivider, his predecessors in title, other owners <br />of property in the section, and by the general public since at least 1972; and <br /> <br />WHEREAS, although approval of the subdivision of the aforesaid tract by the Hall <br />County Board of Supervisors is not necessary, the Board of Supervisors desire to indicate its <br />approval of said subdivision as conditioned herein. <br /> <br />NOW BE IT RESOLVED that the Hall County Board of Supervisors consents to and <br />approves of the subdivision of a th~ above-described tract of land owned by Darwin Katzberg <br />provided the following terms are included in a subdivision agreement pertaining to said <br />subdivision, to wit: <br /> <br />1. Dedication of Right-of-Way. The Subdivider agrees to dedicate the <br />Southerly most thirty-three (33) feet of Subdivider's tract ofland as right-of-way for future <br />public road purposes. Until such time as said right-of-way is opened as a public road by the Hall <br />County Board of Supervisors, the Subdivider shall agree to waive any right to maintenance of <br />said right-of-way as a public road. <br /> <br />2. Access. The Subdivider agrees to waive any rights he has or may have <br />pursuant to Neb.Rev.Stat. 939-1713 through 1718, as amended, for the establishment of public <br />access or public road to the above-described tract of land. <br />
