<br />RESOLUTION #01-00 ~~ <br /> <br />,/ <br />P 01523 <br /> <br />A RESOLUTION TERMINATING THE DELEGATE AGENCY AGREEMENT BY AND <br />BETWEEN THE COUNTY OF HALL AND HALL COUNTY HEAD START <br /> <br />WHEREAS, the County of Hall, Nebraska and Hall County Head Start, Inc., a private <br />nonprofit Nebraska Corporation, entered into a delegate agency agreement for the operation of a <br />Head Start Program within Hall County; and <br /> <br />WHEREAS, the United Stated Department of Health and Human Services has given <br />notice to the County of Hall of the tennination of the Head Start grants to the County of Hall; <br />and <br /> <br />WHEREAS, 45 C.F.R. 974.34 provides that title to equipment acquired by a recipient <br />with Health and Human Services funds shall vest in the recipient subject to the condition that the <br />Department of Health and Human Services may order the transfer oftitle to any such property to <br />the federal government or to a third party; and <br /> <br />WHEREAS, it is anticipated that the Department of Health and Human Services will <br />order the transfer of equipment purchased with federal Head Start grant funds to the federal <br />government or to a third-party. <br /> <br />BE IT RESOLVED as follows: <br /> <br />1. The Hall County Board of Supervisors hereby tenninates its Delegate Agency Agreement <br />with Hall County Head Start, Inc. effective October 1, 2001. <br /> <br />2. The Hall County Clerk and County Supervisor liaison members of the Hall County Head <br />Start, Inc. board of directors are hereby authorized and directed to transmit or cause to be <br />transmitted to the Department of Health and Human Services an inventory of equipment and <br />personal property acquired by or on behalf ofthe County of Hall with federal Head Start <br />grant funds. <br /> <br />3. Upon receipt of instructions to transfer title, the Chainnan of the Hall County Board of <br />Supervisors and the Hall County Clerk are hereby authorized and directed to execute such <br />assignments of motor vehicle titles, bills of sale, and such other documents as necessary to <br />transfer all equipment and personal property acquired by or on behalf of the County of Hall <br />with federal Head Start grant funds to the federal government or to a designated third-party <br />designated by the Department of Health and Human Services to receive such property. <br /> <br />4. In the event instructions for the transfer of equipment and personal property are not received <br />within 120 days after receipt of the inventory, the Hall County Board of Supervisors hereby <br />authorizes disposition of the aforesaid property in accordance with 45 CFR 974.34(g)(1). <br />
