<br />RESOLUTION #01- () 0 \ 9 <br /> <br />~Ot:t29 <br /> <br />A RESOLUTION RENEWING A PERMIT FOR CONDITIONAL USE OF THE <br />EASTERLY TWENTY (20) ACRES OF THE NORTHWEST QUARTER (NW ~) OF <br />SECTION THIRTY-THREE (33), TOWNSHIP NINE (9) NORTH, RANGE ELEVEN (11) <br />WEST OF THE 6TH P.M., HALL COUNTY, NEBRASKA <br /> <br />WHEREAS, Muckel's Aerial, Inc., hereinafter referred to as the "pennittee," filed an application <br />to renew the conditional use of the Easterly Twenty (20) acres of the Northwest Quarter (NW Y4) <br />of Section Thirty-Three (33), Township Nine (9) North, Range Eleven (11) West Of The 6th <br />P.M., Hall County, Nebraska; and <br /> <br />WHEREAS, a public hearing on said renewal application was held by the County Board <br />of Supervisors ofRall County, Nebraska on February 27,2001, following publication of notice <br />as required; and <br /> <br />WHEREAS, use of the aforesaid lands for the operation of an agricultural chemical aerial <br />application facility is a permissible conditional use within the zoning district that encompasses <br />the above-described lands. <br /> <br />NOW BE IT RESOL VED the pennittee's renewal application for the conditional use of <br />the above-described property is hereby granted for a period of twenty (20) years subject to the <br />following conditions: <br /> <br />1. The pennittee shall make such necessary provisions to ensure the security of toxic and <br />hazardous materials stored, used, or handled upon the premises. <br /> <br />2. The pennittee shall comply with all applicable rules and regulations of the Nebraska <br />Department of Environmental Quality and the United States Environmental Protection <br />Agency concerning the storage and handling of the toxic and hazardous chemicals used, <br />stored or handled upon the premises. <br /> <br />3. The airstrip, pennitted hereby as an accessory use, shall be used solely as a private airstrip. <br /> <br />4. The Pennittee shall comply with all applicable rules and regulations of the Federal Aviation <br />Administration and the Nebraska Department of Aeronautics concerning the operation of <br />aircraft and aircraft landing facilities. <br /> <br />5. The rights granted herein shall not be assigned, conveyed or transferred without the prior <br />consent of the County Board of Supervisors of Hall County. <br /> <br />6. This Conditional Use Pennit may be tenninated if permittee fails to comply with any of the <br />conditions, restrictions and obligations set forth herein. In the event of noncompliance, the <br />County Board of Supervisors shall notify the pennittee in writing setting forth the specific <br />area or areas of noncompliance.
