PUBLIC PARTICIPATION - Chairman Lancaster called for public participation and no one <br />responded. <br /> <br />4 DON KELLY DISCUSSION REGARDING RAILROAD EASEMENT AT THE AIRPORT - DQn <br />Kelly requested to speak to the county board concerning the railroad easement at the Hall <br />County Airport. He distributed pictures to the board member showing the condition of the tracts <br />and the spills of asphalt. <br /> <br />He stated that Hall County owns the easement and the Hall County Airport Authority operates <br />and manages the airport. Mr. Kelly expressed concern on the condition of the tracts and the <br />over-growth of weeds on the easement. He also addressed the spills of the asphalt and the oil <br />from the train cars that are hauling the products. He stated that he does not know what kind of <br />chemicals are in the asphalt. He addressed the language in the lease agreement regarding the <br />liabilities and who would be responsible. The leasor can use the tracts anytime but he <br />questioned who is responsible for the easement property. He also stated that the conditions of <br />the ties in the rail tract are in bad shape and questioned if the Airport Authority has acted <br />properly on this matter. Jeffries quoted language in the lease that addresses the ownership. <br />He questioned who owns the tracts. Mr. Kelly stated that he thought the railroad owns the <br />tracts, and in this case the railroad has not keep up the condition of the tracts. <br /> <br />Mr. Kelly is concerned on the condition of the tracts that are on his property and he is <br />concerned on what the industries will be bringing in on across his land. Hartman stated that he <br />walked the tract and it needs to be repaired. He also stated that if there were a spill it would go <br />into the drainage ditch. <br /> <br />Jim asked Jerry what responsibilities the county would have and Jerry stated that under the <br />state statue the county owns the property but the airport authority runs it. He stated that he <br />would have to look at the state statutes regarding the airport authority to determine where the <br />responsibility would lie. The airport authority board has the management authority. <br /> <br />Lancaster asked Jerry if he would look at this and make a recommendation. Hall County owns <br />the easement on his property. This will be put on the agenda in two weeks to address the <br />issues and questions. <br /> <br />9 JOHN AMICK HALL COUNTY HISTORICAL SOCIETY DISCUSS AND APPROVE BALLOT <br />LANGUAGE FOR HISTORICAL SOCIETY - John Amick stated that the County Board is aware <br />of the proposal that the Historical Society wants to place on the November ballot. He worked <br />with County Attorney Jerry Janulewicz to prepare the resolution and ballot language. According <br />to state statute that if the tax rate is implemented it would equal one-tenth of one cent which <br />would generate about $78,500.00 per year. Logan made a motion and Jeffries seconded to <br />approve Resolution #02-0059 and place this issue on the November General Election Ballot. <br />Arnold, Eriksen, Hartman, Humiston, Jeffries, Lancaster and Logan all voted yes and none <br />voted no. Motion carried. <br />
