<br />RESOLUTION #02- t)t)~o...., <br /> <br />(20020215 <br /> <br />A RESOLUTION DESIGNATING NEBRASKA PUBLIC POWER DISTRICT <br />AS TRANSFEREE OF PROPERTY LOCATED AT THE <br />CORNHUSKER ARMY AMMUNITION PLANT <br /> <br />WHEREAS, Public Law 103-337, sec. 2836 authorizes the Secretary of the Army to <br />convey to the Hall County, Nebraska, Board of Supervisors or its designee all right, title and <br />interest ofthe United States in and to the real property that is the site ofthe Cornhusker Army <br />Ammunition Plant, hereinafter referred to as "CAAP," for fair market value, said property to be <br />used in a manner consistent with the CAAP Reuse Committee's Comprehensive Reuse Plan, <br />hereinafter referred to as the "Reuse Plan"; and <br /> <br />WHEREAS, Nebraska Public Power District has proposed a plan to utilize the real estate <br />described herein for development of a power plant; and <br /> <br />WHEREAS, the use of said property for industrial use is consistent with the CAAP Reuse <br />Committee's Comprehensive Reuse Plan. <br /> <br /> <br />BE IT RESOLVED, the Hall County Board of Supervisors hereby designates Nebraska <br />Public Power District, hereinafter referred to as "NPPD," as the transferee of the following lands <br />located at the Cornhusker Army Ammunition Plant, to wit: <br /> <br /> <br />All oftracts 32, 33, 35, 36, and a portion of tract 37 as marked on attachment "A" <br /> <br />BE IT FURTHER RESOLVED, the above described transfers shall be subject to the <br />following conditions, restrictions, and limitations: <br /> <br />1. Survey And Changes In Descriptions And Parcels. The above description of land is <br />approximate and intended to describe only the general area to be conveyed to NPPD. <br />NPPD shall furnish a perimeter survey of said parcel to the Hall County Board of <br />Supervisors. The Hall County Board of Supervisors and the CAAP Reuse Committee <br />may require changes to any parcel description, boundary, or dimensions or require <br />designations of easements as necessary to accommodate the needs of the County of <br />Hall or the CAAP Reuse Committee. <br /> <br />2. Abandonment Of Designation. The County of Hall may rescind and cancel this <br />designation in whole or in part if the designation is abandoned by NPPD. <br /> <br />3. Transfer And Assignments. This designation ofNPPD as transferee shall not be <br />assigned or transferred by NPPD except with written prior consent of the Hall County <br />Board of Supervisors <br />
