<br />( 03/168 <br /> <br />2 COUNTY ATTORNEY a. CONSIDER & APPROVE RIGHT OF WAY LICENSE <br />AGREEMENT FOR SID & TAMI SMITH - County Attorney Jerry Janulewicz presented a <br />license agreement for a price of property located in the north central part of the county. <br />This is on 110th Road, which is a county road that is closed. The Smiths are requesting <br />permission from the county to use the right-of-way for a drive way to their property. This <br />proposed agreement provides the legal description of the property and the conditions for <br />use. It is to be used for a private driveway, there are to be no structures or obstructions <br />that would impair the use of the property by emergency vehicles and it would allow the <br />County to close the road if an unsafe condition occurred. It will also have to be posted <br />that it is a private drive. The agreement also allows that it can be terminated with 5 days <br />notice from either party. <br /> <br />Jeffries made a motion and Eriksen seconded to approve the agreement and authorize <br />the chair to sign. Arnold, Eriksen, Hartman, Humiston, Jeffries, Lancaster and Rye all <br />voted yes and none voted no. Motion carried. <br /> <br />2b PRELIMINARY DISCUSSION OF HUMANE SOCIETY AGREEMENT - Janulewicz <br />stated that last Friday he met with representatives from the Hall County Sheriff's <br />Department and the Humane Society concerning the current agreement with the <br />Humane Society. This is a 1985 agreement and the Humane Society would like to <br />update the agreement and negotiate the fees for the services. The Sheriff's office has to <br />process this claim and they do not feel that they should be involved in that process. <br />Janulewicz also stated that they need to look at the resolution that was adopted in 1968 <br />regarding the pet regulations, he checked with the county treasurer and they have not <br />sold any dog tags for years. The county may also want to look at the regulations dealing <br />with animals. They would like to have a committee to work on this. <br /> <br />Jeffries stated that the criminal justice committee has discussed this and they could work <br />on this agreement. Janulewicz distributed copies of the old agreement. <br /> <br />Janulewicz also distributed copies of the proposed changes to interlocal agreement with <br />drug court. This addresses Supervisor Eriksen's concerns regarding county board <br />members on the executive board of drug court. This will be on the county board agenda <br />for July 29, 2003. <br /> <br />PUBLIC PARTICIPATION - Chairman Lancaster called for public participation and no <br />one responded. <br /> <br />11 UPDATE ON THE JAIL-Supervisors Hartman stated that he put this item on the <br />agenda and would like to know what is going on. <br /> <br />Lancaster stated that the long-range planning committee would put this item on the <br />agenda if there were anything new to report. She stated that the county legislation to <br />allow private management would not reach the floor until the next legislative session. <br />They received a letter from the attorney general stating that the present legislation does <br />not give us the option to use private management. The committee met and contacted <br />Kutak Rock to address the county's options and they are get back to them. One option <br />would be for the county to use a bond issue to build the jail and have county people run <br />it. Kutak Rock will get back to the committee as soon as there is something more <br />concrete. <br /> <br />3 <br />
