r 03228 RESOLUTION #03- 6Od..3 A RESOLUTION AUTHORIZING THE EXECUTION OF IDPAA BUSINESS ASSOCIATE AGREEMENTS AND IDPAA MEMORANDUMS OF UNDERSTANDING WHEREAS, pursuant to Neb.Rev.Stat. ~ 23-104(6) (Reissue 1997), Hall County has the power to do all acts in relation to the concerns of the County necessary to the exercise of its corporate powers; and, WHEREAS, pursuant to Neb.Rev.Stat. ~ 23-103 (Reissue 1997), the powers of a County as a body are exercised by the County Board; and, WHEREAS, Congress enacted the Health Insurance Portability and Accountability Act of 1996 ("HIP AA"), governing the protection of and release of Protected Health Information ("PHI"); and, WHEREAS, entities that are "covered entities" W1der HIP AA must enter into business associate agreements and memorandums of understanding when a third party performs certain functions, as specified by HIP AA regulations, on behalf of a "covered entity"; and, WHEREAS, the Board of Supervisors of Hall County, Nebraska desires to authorize its Board Chair to execute HIP AA business associate agreements and HIP AA memorandums of understanding in the name of and on behalf ofthe County of Hall as are approved by the Hall County Attorney. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF HALL COUNTY, NEBRASKA THAT its Board Chair be hereby authorized to execute HIP AA business associate agreements and HIP AA memorandums of understanding in the name of and on behalf of the County of Hall as are approved by the Hall County Attorney.
