<br />~03226 <br /> <br />RESOLUTION#03-0~ <br /> <br />.:~- <br /> <br />A RESOLUTION APPOINTING A IDPAA PRIVACY OFF1CER AND STEERING <br /> <br />COMMITTEE <br /> <br />WHEREAS, pursuant to Neb.Rev.Stat. 9 23-104(6) (Reissue 1997), Hall County has the <br />power to do all acts in relation to the concerns of the County necessary to the exercise of its <br />corporate powers; and, <br />WHEREAS, pursuant to Neb.Rev.Stat. 9 23-103 (Reissue 1997), the powers of a County <br />as a body are exercised by the County Board; and, <br />WHEREAS, Congress enacted the Health Insurance Portability and Accountability Act of <br />1996 ("HIP AA "), governing the protection of and release of Protected Health Infonnation <br />("PHI"); and, <br /> <br />-------_....-...--~-----~------- <br />WHEREAS, entities such as Hall County are impacted by HIP AA because of the Health <br />Plan and Health Care aspects of county government which contain PHI; and, <br />WHEREAS, Hall County has already established a HIP AA Compliance Initiative and <br />appointed a HIP AA Coordinator, so that Hall County will meet the federal mandates imposed by <br />HIP AA; and, <br />WHEREAS, Hall County requires a HIP AA Steering Committee, which will work with <br />the HIP AA Coordinator and eventually with the HIP AA Privacy Officer to facilitate the HIP AA <br />compliance efforts of Hall County; and, <br />WHEREAS, Hall County appoints and recognizes Marla Conley, Hall County Clerk, as the <br />County HIP AA Privacy Officer; and <br />WHEREAS, Hall County appoints and recognizes the following persons or their <br />designees, by virtue of their responsibilities for Hall County and/or the PHI within their <br />Departments, as the Hall County HIP AA Steering Committee; <br />Hall County Attorney Jerry Janulewicz, Chairperson, HIPAA Coordinator, <br />Hall County Clerk Marla Conley, HIP AA Privacy Officer, Vice-Chairperson, <br />Hall County Board Assistant Stacey Ruzicka, <br />Hall County Corrections Director David Arnold, <br />Hall County Veteran's Services Officer Don Shuda, <br />NOW, THEREFORE, BE IT RESOLVED BY TIffi HALL COUNTY BOARD OF <br />
