(03206 RESOLUTION #03-~ A RESOLUTION AUlHORIZING A CONDmONAL USE OF THE NORTHEAST QUARTER (NEl/4) OF SECTION TWENTY (20) , TOWNSHIP ELEVEN (11) NORTH, RANGE TWELVE (12) WEST OF THE 6th P.M., HALL COUNTY, NEBRASKA. WHEREAS, Glenwood Hargens and Jane Hargens, husband and wife, as owner, and Charles Encinger, doing business as Electronics Services, as lessee, have made a renewal application for a Conditional Use Permit for the erection, maintenance, and use of a 180' radio communications tower and a 10'x 12' equipment building, all upon the following described property, to wit: Cameron Township, in the Northeast Quarter (NEl/4) of Section Twenty (20) , Township Eleven (11) North, Range Twelve (12) West of the 6th P.M., Hall County, Nebraska; and WHEREAS, a public hearing regarding said renewal application was held the March 25, 2003, after due and proper notice of same being afforded the public; and WHEREAS, the said property is located within the AG-l Agricultural Zoning District; and WHEREAS, the Hall County Board of Supervisors is empowered under the Zoning Resolution to grunt a Conditional Use Permit under circumstances of this nature upon a determination that the proposed use is consistent with the, intent of the AG-l Agricultural district. NOW BE IT RESOLVED that the renewal application for conditional use of the above-described property for the above-stated uses be and is hereby approved subject to the following conditions. 1. The premises and the facilities thereon shall at all times be maintained in a neat and orderly condition. 2. Noxious weeds on the premises shall be controlled pursuant to state and local laws and regulations. 3. Applicant shall comply with all rules and regulations of the Federal Aviation Administration regarding the construction, height, design, and maintenance of the communication tower placed upon the above-described property. 4. Said tower shall be used for communication purposes only.
