Held a Board of Equalization meeting. <br /> 9:11 a.m. Adjourned the Equalization meeting and returned to the regular meeting. <br /> Public participation — Chair Peterson called for public participation and no one <br /> responded. <br /> 6. PUBLIC WORKS - A) DISCUSSION & POSSIBLE ACTION ON BUFFALO ROAD <br /> NEAR AMICK ACRES - Don Robb stated that he met with John Amick and discussed <br /> the issue regarding the gate that was moved closer to the eagles next. The road and <br /> people were in the area when the eagles built the nest there. He talked to Amanda and <br /> she suggested to try it for a year. Don said his recommendation is to leave the gate <br /> there. They have filled in the ditch and graved it for the bus and maintainer to turn <br /> around. <br /> John Amick said he also talked to Amanda and provided a copy of the Bald Eagle <br /> Management guide to the board members. He read some of the highlighted areas and <br /> stressed that it is important to not disturb the nesting site of the bald eagle during <br /> breeding. Jim Castleberry was also present and lives in the area. He said they have <br /> not recently seen the eagles but they do leave the nest this time of year. The gate is <br /> now 250 feet from the nest site. John said he also talked to Brain Rainforth from <br /> Doniphan School. In his information he included a copy of an invoice from Ace Eaton <br /> from Kearney on the cost of two 36 X 30 metal pipes at the cost of $5,139.00. His <br /> request from the county board is to purchase one 36 X 30 pipe and ask the school <br /> board to purchase one 36 x 30 pipe for the turn-around for the maintainer and the <br /> school bus and to move the gates back to the original site. <br /> Mr. Peterson ask what his objection is to this. Mr. Amick said first the eagles and also <br /> the ditch is steep and deep home owners association paid to put the culverts back an <br /> and dredged the ditch. It is deeper and steeper he expressed concern that someone <br /> could back into the ditch, it is dark and not lit and people dump trash and create a <br /> general nuisance. He also noted an issue on Elm Island Road that was gated. He feels <br /> there is a safety issue with the bus turning around there. He questioned why disturb the <br /> eagles. Mr. Robb suggested a wait and see if there are any issues with the gate <br /> placement. <br /> Sorensen noted that the culverts would have to be 40 feet long. He noted the materials <br /> could be $6,800 for the pipes $5,000 for the dirt, equipment and fuel ad $12,000 for <br /> labor to replace the culverts. Scott is recommended to leave the gate where it is. <br /> Mr. Amick read regulation regarding violating the act and the fines. He also said they <br /> have a lot of bird watchers in the area. He said that 66% of his taxes go to the schools <br /> 4 <br />
