RESOLUTION #22- C <br /> A RESOLUTION AUTHORIZING A CONDITIONAL USE OF THE NORTHWEST QUARTER OF THE <br /> NORTHEAST QUARTER (NW1/4NE1/4)AND A PART OF THE NORTHEAST QUARTER OF THE <br /> NORTHWEST QUARTER (Pt NE1/4NW1/4) OF SECTION THIRTY(30),TOWNSHIP NINE (9) <br /> NORTH, RANGE TWELVE (12)WEST OF THE 6T" P.M., HALL COUNTY, NEBRASKA <br /> WHEREAS, Ed Poorman, hereinafter referred to as "Applicant", is the lessee with respect <br /> to the following described real estate, to-wit: <br /> The Northwest Quarter of the Northeast Quarter (NW1/4NE1/4) and a part of the <br /> Northeast Quarter of the Northwest Quarter (Pt NE1/4NW1/4) of Section Thirty (30), Township <br /> Nine (9) North, Range Twelve (12) West of the 6th P.M., Hall county Nebraska; also known as <br /> 19387 W Rainforth Road and <br /> WHEREAS, Robert Garcia, hereinafter referred to as "Owner", is the record title owner <br /> of the above-described real estate; and <br /> WHEREAS, the above-described real estate is located within the AG-R Zoning District; <br /> and <br /> WHEREAS, Applicant and Owner have presented an application for a Conditional Use <br /> Permit to the Hall County Board of Commissioners requesting a Conditional Use Permit for a <br /> Paintball Course and/or Paintball Fields to be located on the above-described real estate; and <br /> WHEREAS, on 4- (a.70,a public hearing on said application was held at a <br /> regular meeting of the Hall county Board of Commissioners following notice of the same as <br /> provided by statute; and <br /> WHEREAS, the Hall County Board of Commissioners finds that such use is authorized <br /> under the Conditional Uses within the AG-R District; that such use will not adversely affect the <br /> public interest; and that said Commissioners are empowered under the Zoning Resolution to <br /> permit such Conditional Use. <br /> NOW, THEREFORE, BE IT RESOLVED that the Hall County Board of Commissioners hereby <br /> grants to Applicant a Conditional Use Permit for a period of Five (5) years to use the above- <br /> described real estate for a Paintball Course and/or Paintball Fields subject to the following <br /> conditions, restrictions and limitations upon the use of the aforesaid property by Applicant and <br /> Owner. <br /> 1. This Conditional Use Permit shall terminate on 4 but may be sooner <br /> terminated if applicant fails to comply with any of the conditions, restrictions and obligations <br /> set forth herein. In the event of noncompliance, the Hall County Board of Commissioners or <br /> the entity having jurisdiction shall notify Applicant, in writing, of such noncompliance setting <br /> forth the specific area of noncompliance.
