NOW THEREFORE,the Hall County Board of Commissioners hereby resolves and authorizes the use of <br /> Federal ARPA funds to make pay premium pay as follows: <br /> 1. The premium payment is in recognition of work performed between January 27, 2020 and <br /> December 31, 2020 in conjunction with the employee's continued employment through January <br /> 28, 2022. <br /> 2. In order to encourage employee retention, to be eligible for premium pay an employee recipient <br /> must be eligible under the provisions set forth in ARPA as well as must: <br /> a. Be a current, regular, permanent full-or part-time employee of Hall County; and <br /> b. Be continuously employed by Hall County from the approval date of this Resolution through <br /> January 28, 2022; and <br /> c. Have been employed as a regular, permanent full-or part-time employee by Hall County <br /> during calendar year 2020 (See limitation at#5 below); and <br /> d. Have performed essential work(as referred to/defined above) at least one day during each <br /> calendar month beginning January 27, 2020 and ending December 31, 2020. <br /> e. Not have earned more than$75,379.20 in gross wages from Hall County during 2020; and <br /> f. Not be an elected official. <br /> g. Not otherwise be eligible to receive premium pay as a result of a union contract with Hall <br /> County. <br /> 3. The County agrees to make this payment in addition to an employee's regular pay. <br /> 4. The payment for each eligible employee will be calculated as follows: <br /> a. Determine the "base hourly wage" of the employee as of the last day of December 2020 or <br /> the last day the employee was employed by Hall County in 2020. For employees paid <br /> hourly, use their hourly rate. For employees with an annual salary, calculate the hourly rate <br /> by dividing the annual salary by the number of regularly scheduled hours per week and <br /> further dividing by 52 weeks. The value of a regular stipend will be included in order to <br /> calculate the base hourly wage. Overtime pay or other additional pay(excluding typical sick, <br /> vacation, and holiday pay)will not be included in the determination of the base hourly <br /> wage. <br /> b. Create a "base annual wage" for the employee by multiplying the number of regularly <br /> scheduled hours of work per week by 52 weeks. For regular,full-time employees scheduled <br /> to work 40 hours per week this is 2080 hours.The calculation for"base annual wage" <br /> excludes overtime pay. <br /> c. The employee's"premium pay value" is then determined by multiplying the employee's <br /> base annual wage by four percent (4%). The premium pay value is the gross value of what is <br /> being paid to the employee. Taxes and other withholding, such as FICA and retirement, will <br /> be deducted as with an employee's regular paycheck. (However, see also parts 4.d., 5., and <br /> 6. below.) <br /> d. Pursuant to ARPA, premium pay when added to the employee's regular pay cannot exceed <br /> 150%of the average annual wage for all occupations in the State of Nebraska as defined by <br /> the Bureau of Labor Statistics Occupational Employment and Wage Statistics, or Hall <br /> County's average annual wage as defined by the Bureau of Labor Statistics Occupational <br /> Employment and Wage Statistics, whichever is higher. If an employee's wages for 2020 were <br /> under$75,379.20, but the total premium pay value would push the employee above <br />
