BOARD OF COMMISSIONERS <br /> HALL COUNTY, NEBRASKA <br /> RESOLUTION #21- 6 08 <br /> A RESOLUTION SETTING FORTH FINDINGS OF FACT AND GRANTING LOCAL SITING APPROVAL TO <br /> SMART SOIL LLC FOR A SOLID WASTE PROCESSING FACILITY <br /> WHEREAS, the Hall County Board of Commissioners ("Hall County Board") hereby is <br /> authorized by the Nebraska Local Siting Act pursuant to Neb. Rev. Stat. § 13-1701 et seq. <br /> (Reissue 2012)to approve or deny local siting approval for a solid waste processing facility; <br /> WHEREAS, the Hall County Board establishes the following Findings of Fact: <br /> 1. Smart Soil LLC filed an Application for the siting of a composting facility located <br /> in the Southeast Quarter (SE%) of Section Nineteen (19),Township Eleven (11) North, Range <br /> Twelve (12) West of the 6th P.M., Hall County, Nebraska. <br /> 2. The Applicant properly provided notice to neighboring landowners pursuant to <br /> Neb. Rev. Stat. § 13-1704. <br /> 3. A public hearing was held pursuant to Neb. Rev. Stat. § 13-1706 before the Hall <br /> County Board on January 12, 2021. Testimony and exhibits were received by the Hall County <br /> Board in support of the Application. There was no testimony in opposition to the Applicant's <br /> request for local siting approval. <br /> 4. Following the hearing,the Hall County Board left the public comment period <br /> open for a period of 30 days for written comments to be submitted pursuant to Neb. Rev. Stat. <br /> § 13-1706. <br /> 5. Based upon the record before the Hall County Board, the Hall County Board finds <br /> the following criteria have been met pursuant to Neb. Rev. Stat. § 13-1703: <br /> A. Neb. Rev. Stat. §13-1703(1) -The facility is necessary to meet the solid <br /> waste processing needs of the area; <br /> B. Neb. Rev. Stat. §13-1703(2) -The facility is designed, located, and <br /> proposed to be operated so that the health, safety, and welfare of the <br /> local population will be protected; <br /> C. Neb. Rev. Stat. §13-1703(3) -The facility is located to minimize <br /> incompatibility with the surrounding area and has been reviewed by the <br /> Hall County Regional Planning Commission; <br /> 1 <br />
