9:05 a.m. Held a Board of Equalization meeting. <br /> 9:08 a.m. recessed the Board of Equalization meeting the executive session will be held <br /> later. <br /> PUBLIC PARTICIPATION - Chair Lancaster called for public participation and no one <br /> responded. <br /> 4 COUNTY ATTORNEY— EXECUTIVE SESSION REGARDING PENDING <br /> LITIGATION —This executive session will be held later. <br /> 5.9:15 MARY RIDDER WITH NEBRASKA PUBLIC SERVICE COMMISSION <br /> PRESENTATION - Mary Ridder with the Nebraska Public Service Commission was <br /> present to update the County Board. She stated on February 5th they opened the public <br /> investigative hearing regarding the blocked crossing and in June the formal complaint <br /> was filed against Burlington Northern, Nebraska Central and Union Pacific. The UP and <br /> Nebraska Central adopted a new policy regarding holding the trains for 180 days. When <br /> the trains are heading north they will wait outside of town until Nebraska Central comes <br /> and gets them. When the trains are heading south they will wait on Airport Road until <br /> Nebraska Central bring them in town. On September 15, the complaint was dismissed. <br /> If there are changes on the policy they are to be notified. The emergency responders, <br /> educational institutions and general public and government officials are to notify them if <br /> there are issues. In September and October they learned that Burlington Northern will <br /> employ a new process they will honor green or red lights. It will benefit North Road and <br /> Highway 2 but there could be some concerns on Monitor and Engleman Roads. This is <br /> for 180 days and Burlington Norther is to contact them if there are any changes. This <br /> needs to be a permanent solution and they hope a formal complaint will not be <br /> necessary. <br /> Lancaster thanked her for coming without her help this would have not been resolved. <br /> Ms. Ridder noted that everyone was doing their job and that is what they are here to <br /> do. <br /> Quandt thanked the commission and appreciates the community leaders. Everyone <br /> come together to solve this problem. <br /> Ms. Ridder stated that she is also working in another area of the state and wants the <br /> rest of the state to know and encourages people to come forward. The records are <br /> important. <br /> 6. COMMENTS FROM SHAUN SHEPARDSON & KRIS DUBBS — Karen Bredthauer <br /> introduced Kris Dubbs and stated Shawn was not able to be here today. Ms. Dubbs <br /> stated she wants to acknowledge everyone that was involved on the Burling Northern <br /> issues. She read a statement regarding the issue of the blockage on Highway 2. They <br /> have worked on this for a year. She noted how Shawn documented the blockages on <br /> the road. This has taken a group effort to keep this driving forward.
