PUBLIC PARTICIPATION — Chair Lancaster called for public participation. Willy Skala, 4340 Prairie Creek Circle noted that JBS handles 7 million dollars a day and is a big industry. He noted that the paunch they have now is dry and there is some odor but it is not aggressive and they work it daily. This project needs attention and support. Hartman did someone pay him to do this and ask if he would build a home next to it and Willy stated no one ask him and there is no odor. Lancaster thanked him for coming. 4. COUNTY ATTORNEY—A) DISCUSSION & POTENTIAL ACTION REGARDING ENGINE BRAKE RESOLUTION — Deputy County Attorney Sarah Carstensen had prepared a draft resolution and she ask the board if they had questions. Peterson noted the general restrictions and the laws that were cited and the board's authority to do this. The signs will be posted and give notice of the restrictions. He questioned if the previous notice will be rescinded and Sarah stated it should be left in place but this will update the signs and give notice of the 2 mile jurisdiction. The fine has also been increased to $500.00. Quandt stated this had been a problem for many years this will give a zone when the truck can slow down he thinks this a good way to go. Quandt made a motion and Bredthauer seconded to move forward with the resolution for the engine brakes. The map show the 2 mile jurisdiction. Hartman ask if they were going to address loud radios and loud mufflers there is no noise ordinance. The muffler brakes may save a life. Sarah Carstensen noted that there is discretion if you look at the situation and you try to minimize damage to people or property. Quandt noted that there are ordinances against excessive noise and disturbing the peace. Law enforcement would have to be at the location Mike Dobesh 2491 South 110th Road, Wood River, requested to address the County Board he stated he is not opposed to the areas by JBS and understands the reasoning. But expressed concern on the 2 mile jurisdiction. He noted that there are 175,000 acres of corn and at 200 bushels an acres it would be 23,625 loads of corn and with 15,000 acres of beans at 60 bushels an acres it would be 675 loads of beans and that is just the grain it does not address fuel, construction or fertilizer. His issue is safety and he expressed concern on the area on Hwy 281 that it would affect they already have school zones and hospital zones he would like to expand the area around JBS or use a time frame during day hours. He also expressed concern that the older truck cannot install the mufflers. Hurst expressed concern and noted there have not been any tickets written even in Lancaster County and questioned if this is necessary. He also noted the issues with the trains they are 24 hours a day and we have no control on them. It is a waste of time. 2
