RESOLUTION#19 f T P A RESOLUTION AUTHORIZING THE RENEWAL OF A CONDITINAL USE PERMIT FOR LOT TWO(2),BUDD SECOND SUBDIVISION,HALL COUNTY,NEBRASKA WHEREAS, Bosselman Energy Inc. made application to the Hall County Building-Zoning Administrator for the renewal of a permit for the conditional use of a certain tract of real estate located within the zoning authority of the County of Hall,to-wit: The Southeast Quarter of the Northeast Quarter (SE 1/4 NE 1/4) of Section One (1), Township Ten (10) North, Range Twelve (12) West of the 6th PM in Hall County, Nebraska, also known as Lot Two(2),Budd Second Subdivision. WHEREAS, pursuant Hall County's Zoning Resolution, the Hall County Board of Supervisors may authorize permitted conditional uses which are in conformance with the intent of the district in which it is proposed to be located upon consideration of the factors set forth in the Zoning Resolution; and WHEREAS, on August 20, 2019, the Hall County Board of Supervisors held a public hearing on said application following due and proper publication of notice. THEREFORE, BE IT RESOLVED that the application for a conditional use of the above-described real estate for operation of a wholesale propane gas distribution facility be hereby approved subject to the following conditions, limitations and requirements: 1. The facility shall be developed in accordance with the site plan dated April 14, 1999, as approved by the Regional Planning Director and the County Building Inspector. 2. The facility shall comply with applicable state and federal licensing regulations concerning storage,transportation and sales of propane gas. 3. Bulk propane tank areas shall be fenced with a chain link security fence of not less than eight(8) feet in height. 4. There shall be no dealer sales or individual sales on site. 5. Entrance to the facility shall be through the northerly drive and exit from the facility shall be through the southerly drive. 6. This conditional use permit approval shall be valid for a five year period from and after August 20, 2019,subject thereafter to application for renewal.
