RESOLUTION #19- I I,CQ <br /> A RESOLUTION AUTHORZING THE CONDITIONAL USE OF A PART OF THE WEST <br /> ONE-HALF OF THE WEST ONE-HALF (W 1/2 W 1/2) OF SECTION TWENTY-FIVE (25), <br /> TOWNSHIP ELEVEN(11) NORTH, RANGE ELEVEN (11) <br /> WEST OF THE 6TH P.M.,HALL COUNTY,NEBRASKA. <br /> WHEREAS, American Tower has made an application for a conditional use permit for the <br /> conditional use of the following-described property for the erection, operation and maintenance of a <br /> monopole communications tower having a height of 69 feet, all upon the following-described real <br /> estate,to-wit: <br /> PART OF THE WEST ONE-HALF OF THE WEST ONE-HALF (W 1/2 W 1/2) OF <br /> SECTION TWENTY-FIVE (25), TOWNSHIP ELEVEN (11) NORTH, RANGE ELEVEN (11) <br /> WEST OF THE 6TH P.M., HALL COUNTY,NEBRASKA; and <br /> WHEREAS,a public hearing regarding said application was held on the 8th day of July,2019, <br /> after due and proper notice of same being afforded the public; and <br /> WHEREAS, the said property is located within the AG-SE Zoning District; and <br /> WHEREAS, the Hall County Board of Supervisors is empowered under the Hall County <br /> Zoning Resolution to grant a permit for the conditional use of the property for development and <br /> maintenance of a tower within the AG-SE Zoning District. <br /> NOW,THEREFORE,BE IT RESOLVED that the application for a conditional use permit for <br /> the conditional use of the above-described real estate for the above-stated uses should be and hereby <br /> is approved subject to the following conditions: <br /> 1. Maintenance. The premises shall at all times be maintained in a neat and orderly <br /> condition. The towers, antenna support structures, telecommunications facilities and <br /> antennas shall at all times be kept and maintained in good condition, order and repair so <br /> that the same does not constitute a nuisance to or a danger to the life or property of any <br /> person or the public. <br /> 2. Noxious Weeds. Noxious weeds on the premises shall be controlled pursuant to state <br /> and local laws and regulations. <br /> 3. FAA and FCC Compliance. The tower owner shall comply with all applicable rules <br /> and regulations of the Federal Aviation Administration regarding the construction, <br /> height, design and maintenance of the communications tower placed upon the <br /> above-described real estate and applicable rules of the Federal Communications <br /> Commission regarding the use of the tower and antennas. <br /> 4. Tower Use. Said tower shall be used for communication purposes only. <br /> 5. Tower Construction Standards. Said towers, telecommunications facilities and <br /> antennas shall conform to all construction standards set forth in the County Zoning <br /> Resolution, federal and state law, and applicable American National Standards Institute <br /> (ANSI) standards. Upon completion of construction of a tower and prior to the <br /> commencement of use, an engineer's certification that the tower is structurally sound <br /> and in conformance with all of the aforementioned applicable regulatory standards shall <br /> be filed with the Zoning Department. <br />
