RESOLUTION #19- <br /> A RESOLUTION AUTHORIZING A CONDITIONAL USE OF LOT TWO (2) OF BUTLER <br /> THIRD SUBDIVISION, HALL COUNTY, NEBRASKA <br /> WHEREAS, Jacob Usrey, hereinafter referred to as "Applicant," is the lessee with respect to <br /> the following described real estate, to-wit: <br /> Lot Two (2) of Butler Third Subdivision, Hall County, Nebraska, commonly known as 12296 <br /> W. Airport Road, Cairo, Nebraska 68824; and <br /> WHEREAS, Landscaping Solutions, LLC, hereinafter referred to as "Owner," is the record title <br /> owner of the above-described real estate; and <br /> WHEREAS, the above-described real estate is located within the Al Zoning District; and <br /> WHEREAS, Applicant and Owner have presented an application for a Conditional Use Permit <br /> to the Hall County Board of Supervisors requesting a Conditional Use Permit for a Wedding Venue to <br /> be located on the above-described real estate; and <br /> WHEREAS, on April 16, 2019, a public hearing on said application was held at a regular <br /> meeting of the Hall County Board of Supervisors following notice of the same as provided by statute; <br /> and <br /> WHEREAS, the Hall County Board of Supervisors finds that such use is authorized under the <br /> conditional uses within the Al Zoning District; that such use will not adversely affect the public <br /> interest; and that said Board is empowered under the Zoning Resolution to permit such conditional use. <br /> NOW, THEREFORE, BE IT RESOLVED that the Hall County Board of Supervisors, <br /> hereinafter "Board", hereby grants to Applicant a Conditional Use Permit to use the above-described <br /> real estate for a wedding venue subject to the following conditions, restrictions and limitations upon the <br /> use of the aforesaid property by Applicant and Owner: <br /> 1. The above-described said real estate must, at all times, be kept in a clean, neat, and orderly <br /> condition. <br /> 2. The Permittee will follow all federal, state, and local laws, codes, and regulations, including <br /> those with regard to the State Fire Marshall, the Americans with Disabilities Act (ADA), and building <br /> codes. <br /> 3. Permittee will obtain and maintain in good standing all necessary licenses and permits, for <br /> example a Liquor License or Amusement License, and provide copies of all such licenses and permits <br /> to the County Board or its designee upon request. <br /> 4. Permittee will obtain and maintain in good standing an Occupancy Permit. <br /> 5. Operational hours are from 7 am through 1 am, 7 days a week. <br />
