HALL COUNTY BOARD OF EQUALIZATION MEETING NOVEMBER 29, 2016 Purdy made a motion and Schuppan seconded to go into a Board of Equalization meeting. ROLL CALL - Present on roll call were Scott Arnold, Pam Lancaster, Doug Lanfear, Dan Purdy, Gary Quandt, Jane Richardson and Steve Schuppan. CALL TO ORDER — Chairman Arnold called the meeting of the Hall County Board of Equalization to order. NOTICE OF OPEN MEETING LAW— Chairman Arnold read the notice of open meeting law. VERIFY AFFIDAVIT OF PUBLICATION —Affidavit on file. MINUTES - Purdy made a motion and Lanfear seconded to place on file the minutes of the November 15, 2016 meeting. Arnold, Lancaster, Lanfear, Purdy, Quandt, Richardson and Schuppan all voted yes and none voted no. Motion carried. PUBLIC PARTICIPATION — Chairman Arnold called for public participation and no one responded. NEW OR UNFINISHED BUSINESS — Chairman Arnold called for new or unfinished business and Board Assistant Stacey Ruzicka distributed a letter from Cathedral Daycare, signed by Judy Priess the Director. This is regarding a phone call that she received form the County Treasurer's Office stating that in order for the activity bus to be licensed in January the color of the bus would have to be changed to something other than yellow and the stop arms and flashing lights had to be removed. Peg Pesek stated that in the state manual for the motor vehicle department stated this requirement. Ms. Pesek stated she contacted Betty Johnson with the state and she stated that a County Treasurer's cannot deny registering a vehicle. This requirement to change the color would be a misdemeanor and would only be enforceable by law enforcement. She stated she also contacted other county treasurer's and they also stated you cannot refuse to register it. They were doing what the manual stated. Schuppan questioned why because they are still hauling children. Sheriff Jerry Watson was present and stated you need to look at the intent of the bill but this is new to him. He stated you may need to refer this to the County Attorney. You need to read the state statute and see what the legislative intent was. He expressed concern that this is not necessary if you see a yellow school bus it is hauling precious cargo and you know that. He can understand if the bus was converted to a motor home the color should be changed and arms should be removed. Quandt stated that the buses that haul detasselers have a red strip on them.
