migratory birds. The evident has been presented that there are no leases on 9
properties. He noted the City of York airport case and that ground is now tax exempt
and the Pioneer Village was also tax exempt. He does see that the farmers will apply
for tax exempt status because they would have to nonprofit.
Arnold noted we may not agree with state statutes but we are bound by them. This will
be an appeal case. We do not have enough information.and may have more
information from counsel. If the entire appeal process does not depend on the
determination on one or two parcels. This needs to be addressed.
Lanfear stated the trust is unique from other charitable or nonprofits they do not fit into
the law and it may take a higher authority to make this decision. He does not want to
set precedence. There are times we have to fight. We have to uphold Jan's
recommendation.
Schuppan noted that he discussed how the crane trust came to be. There are very few
cranes in this part of the state or maybe none and buffalo were never part of the crane
trust. He asked what they would add next elk or wolves? Buffalo is a cash crop for
some ranchers.
Mr. Adam stated that this comes down to the use of the land and how it is being used.
This is part of the conservation and preservation effort to bring property back to the
natural state. Mr. Adams stated that this included the sand hills crane and the whooping
cranes. Schuppan noted this happened a long time ago and how do you keep
expanding on the trust to keep it tax exempt and how do you add buffalo. Mr. Adams
argued that Goodwill could lease property to someone else and it would not change the
original intent.
Arnold expressed concern that they may not have enough information and does this fit
the rules. Arnold, Lancaster,
Lanfear, Purdy, Quandt, Richardson and Schuppan all voted yes and none voted no.
Motion carried.
Mr. Zitterkopf requested to address the board. He stated that it was obvious that the
board would not approve the exemption applications for Crane Trust and he realized
that they plan to appeal. It was discussed 2 weeks ago to retain someone to represent
the county and he asked Timothy Moll to do so. Mr. Moll introduced himself; he is a
member of the Rembolt Ludtke law firm and would represent the county in the appeal
process. He has no legal advice at this time. At some later date the board can take
some action to retain him for this purpose.
NEW OR UNFINISHED BUSINESS— Chairman Arnold called for new or unfinished
business and no one responded.
6
