2. COUNTY ASSESSOR - EXECUTIVE SESSION DISCUSS AND APPROVE POTENTIAL SETTLEMENTS FOR TERC CASES — County Assessor Jan Pelland requested an executive session for the TERC cases. Arnold made a motion and Ziola seconded to go into executive session regarding the TERC cases. This executive session is to protect the public interest. Arnold, Lancaster, McFarland, Quandt, Schuppan and Ziola all voted yes and none voted no. Purdy was absent. Motion carried. 9:10 a.m. executive session 9:24 a.m. Quandt made a motion and Arnold seconded to go out of executive session. Chairman McFarland stated that no other subjects were discussed no votes were taken and no action was taken. Arnold, Lancaster, McFarland, Quandt, Schuppan and Ziola all voted yes and none voted no. Purdy was absent. Motion carried. County Assessor Jan Pelland requested to authorize County Attorney Jack Zitterkopf and her to offer settlement to Overhead Door for the 2012 and 2013. TERC cases for the two parcels with a total value of$4,598,079.00 and they agreed on $3,882.040.00 and that is a decrease of $716,039.00 and they will honor this for the 2014 protests. The new construction was valued at $4,670,655.00 and will now be $3,932, 281.00 that is a decrease of $738,374.00. She is asking for the County Board to approve this settlement agreement. Arnold made a motion and Lancaster seconded to approve the settlement agreement for Overhead Door. Arnold, Lancaster, McFarland, Quandt, Schuppan and Ziola all voted yes and none voted no. Purdy was absent. Motion carried. County Assessor Jan Pelland requested to authorize County Attorney Jack Zitterkopf and her to offer settlement for Country Club Holding Association. This is for the land portion of the parcels. They were valued at $7,500.00 an acre and they negotiated with the attorney and came to an agreement for $5,025.00 per acre. The value was $1,122,675.00 and not is at $752,192.00 a decrease of $37,483.00 this is for tax year 2013. They did not file an appeal for 2014 but it will stay the same and they will honor the settlement for 2014. Quandt made a motion and Lancaster seconded to approve the settlement agreement for County Club Holdings. Arnold, Lancaster, McFarland, Quandt, Schuppan and Ziola all voted yes and none voted no. Purdy was absent. Motion carried. Lancaster stated that she appreciates the professional guidance of Mr. Zitterkopf and Jan Pelland by negotiating the settlement outside of TERC it saves time and dollars.
